【摘要】：惩戒是学生管理的必要手段,是教师的工作职责之一。公立学校的教师惩戒权隶属于公权力的范畴,遵循"法有授权才可为"的原则。目前,我国关于教师惩戒的立法存在授权模糊、惩戒方式少、性质单一、没有针对性等问题,不利于维护正常的教学秩序与保障学生的合法权益。相关教育立法可以引入教师惩戒权的概念、增加教师惩戒的种类与方式、明确各种惩戒方式合法行使的具体条件,以完善现有的教师惩戒制度。
[Abstract]:Discipline is a necessary means of student management and one of teachers' duties. The disciplinary power of teachers in public schools belongs to the category of public power, and follows the principle of "law can only be authorized". At present. There are some problems in the legislation of teacher discipline in our country, such as vague authorization, few disciplinary methods, single nature, no pertinence and so on. It is not conducive to maintaining normal teaching order and safeguarding the legitimate rights and interests of students. Relevant educational legislation can introduce the concept of teachers' disciplinary power and increase the types and ways of teachers' discipline. To clarify the specific conditions for the lawful exercise of various forms of discipline in order to improve the existing system of teacher discipline.
