中英择校文化比较:人情伦理与法制公平

【摘要】：我国大陆的择校主要体现为一种由广大家长自下而上发起,以金钱、关系以及权力等方式竞逐(原)公立(重点)学校优质学额的现象。情理法兼顾是我国择校文化的消解方式。导致这种现象的一个很重要的原因在于我国处于由"人治"向法治转型期,公共的法律意识还有待提升、法治的根基不牢、政府执法能力有待完善。英国则是在法治背景下,以就近入学为基准,将择校作为公民的一项权利,以法律形式引导家长和学生择校,择校立法循序渐进。
[Abstract]:The choice of schools in mainland China is mainly reflected in the phenomenon that the majority of parents start from the bottom up and compete for high quality places in public schools by means of money, relationship and power. The consideration of the law of reason is the way to dissolve the culture of choosing school in our country. A very important reason for this phenomenon lies in the fact that our country is in the transition from "rule by man" to "rule by law", the public legal consciousness has yet to be improved, the foundation of the rule of law is not strong, and the ability of the government to enforce the law needs to be improved. On the other hand, under the background of the rule of law, the United Kingdom regards school selection as a right of citizens, guides parents and students to choose school by law, and makes the legislation of school choice gradual and orderly.
