少数民族法律文化视域下民族高校大学生法制观教育研究

【摘要】：我国少数民族法律文化对中华民族法律文化的形成与发展做出了重大贡献。少数民族法律文化是我国法律文化的一个重要组成部分，如果不加深对我国少数民族法律文化的认识与理解，不充分挖掘少数民族法律文化中的优秀与合理成分，我们就无法对我国整体法律文化有一个总体性的认识，就无法描绘其整体的面貌。因此少数民族法律文化中优秀的文化遗产应该得到充分的挖掘，这样也有助于促进当前我国的民族法制建设。我国的民族高校是少数民族法律文化传承与弘扬的重要基地，将少数民族传统法律文化融入民族高校大学生法观教育中，不仅对于传承与弘扬中国少数民族传统法律文化具有重要意义，而且对于丰富民族高校大学生法制观教育的内容和形式，进一步提高民族高校大学生的法制观念，促进依法治国，具有重要的理论和现实意义。 少数民族法律文化是各少数民族在长期的历史发展过程中所共同创造和发展起来的一种生存和生活式样，它由内核和外壳两部分组成，其中内核是支配法律实践活动的价值基础，也可称之为“法统”，外壳指价值基础社会化的过程，也可称之为“法体”。法统的特点是稳定性、普遍性、独立性和一致性。法体的特点是统一性、独立性和一致性。民族地区的法律文化的特点与中国传统法律文化特点相比具有自己的特殊性,主要有民族性、地域性、多样性、变迁性特点。 法制观教育载体和课程教学单一，，大学生基本法律知识水平有待提高，是当前民族高校大学生法制观教育现状。在新的历史条件下我们有必要深入研究民族高校大学生法制观教育的现状及基本特性,这可以为我们充分认识民族高校大学生法制观教育工作中存在的主要问题做好铺垫,对于进一步提高民族高校大学生法制观教育具有重要的意义。 大学生的法律素质培养主要通过社会教育、学校教育和自我教育三种途径实现。最主要的是学校教育。高校法制教育的主旨是培养大学生法律素质,即知法、守法、用法、护法的素养和能力。法律知识、法律意识、用法能力是法律素质的三项基本要素。同时,民族高校大学生法制观教育也具有不同于非民族高校的特殊之处。主要表现在法制观教育对象的特殊性；法制观教育目标及任务的特定性；法制观教育内容的针对性；法制观教育地位的独特性四个方面。 通过以上对当前我国民族高校大学生法制观教育的现状和基本特性的分析，为我们找出大学生法制观教育工作中存在的问题和不足奠定了坚实的基础，大学生的法制观教育定位不明确；大学生的法制观教育效果不明显是当前我国民族高校大学生法制观教育中存在的主要问题，充分认识这些问题可以进一步反映出法制观教育重视不够；传统文化习俗的负面影响；西方敌对势力的干扰是影响当前我国民族高校在大学生法制观教育收到良好效果的主要原因，找出问题存在的主要原因可以为我国民族高校进一步提高大学生法制观教育的针对性和实效性。 我国少数民族法律文化在民族高校大学生法制观中具有重要的作用，其教育作用的发挥主要体现在少数民族法律文化在课堂与实践教学中的作用和少数民族法律文化在维护校园团结和谐中的作用的发挥这些方面。对我国少数民族法律文化的传承与弘扬并不能一蹴而就，对我国民族高校大学生法制观教育也不能忽视，如何才能更好地发挥少数民族法律文化在民族高校大学生法制观教育中的作用，如何将两者更好地结合起来进行研究以达到相得益彰，需要我们作更深入的探讨。
