贵阳市小河区农民工劳动维权教育调查研究

【摘要】： “农民工”主要是指常年或绝大部分时间在城市第二或第三产业从事各类劳务,但其户籍在农村,身份还是户籍制度所认定的农民的这样一个人群。改革开放以来,随着我国工业化、城镇化进程加快,越来越多的农村富余劳动力转移到城市和乡镇企业就业,在这个过程中,形成了一个特殊的社会群体,这就是被称为农民工的我国现代化建设的一支新型劳动大军。我国农民工数量已超过2亿人,他们就业流动性大,有的在农闲季节外出务工、亦工亦农;有的长期在城市居住、生活和工作,已成为产业工人的重要组成部分。农民工已是我国产业大军中的一支重要力量。如何对待进城农民工问题是一个关乎国家长治久安的问题,也是国家构建和谐社会的决策的必然要求,更是我国2亿多农民工的根本需要。在这样些众多的前提下,本文以贵阳市小河区农民工群体为对象的调查显示,农民工在工作时间、工作环境和报酬待遇等权益方面不同程度地受到侵害,而农民工害怕失去工作机会,维权成本过高,维权知识缺乏以及维权意识淡薄等因素制约着农民工维权意识的提高。因此,我们应当唤醒和提高城市农民工的维权意识,并为维权提供良好的制度环境,从而真正改变农民工群体权益受损的状况,实现其向现代市民群体的转化。而如何提高农民工的维权意识呢,国内众多学者在讨论这个问题的时候更多的是借助政府相关机构的力量去帮助农民工去展开维权,却忽略了教育的重点、教育的对象,对农民工的劳动维权意识的培养更多的应该是对农民工的劳动维权教育活动。本文主要通过对小河区农民工展开问卷调查的方式对农民工的权益现状、维权意识、维权方式与途径等进行调查,了解小河区农民工劳动维权教育情况及分析存在的问题,进而从农民工劳动维权教育的重要性、组织体系、教育制度、保障机制等方面进行探讨和思考,寻求适合小河区农民工在维权教育活动中的新发展。通过对我国国家经济技术开发区——小河区的调查,可以帮助我国其他省市更多的农民工自身了解相关的法律知识,知道自己在面对侵权行为时可以采取什么样的方式帮助自己,找谁帮助,这样也避免了农民工在劳动维权之路上走弯路,为全方位构建社会主义和谐社会起到一定作用。
[Abstract]:"Migrant workers" mainly refers to all kinds of labor services done in the second or third industry in the city in most of the year, but their household registration is in rural areas. Identity is a group of farmers identified by the household registration system. Since the reform and opening up, as China's industrialization and urbanization, more and more surplus rural labor employment transfer to the city and township enterprises, in this process, the formation of a special social group, which is known as a new labor force of China's modernization construction of migrant workers. The number of migrant workers in China has more than 200 million people, their employment mobility, some migrant workers, but also workers in the slack season; some long-term residence in the city, life and work, has become an important part of the industrial workers. Migrant workers have been an important force in the industrial army of our country. How to deal with the problem of migrant workers is a matter of national long-term stability. It is also the inevitable requirement for the decision-making of building a harmonious society. It is also the fundamental need of more than 200 million migrant workers in China. In such large groups of migrant workers under the premise of taking Xiaohe District of Guiyang city as the display object of the survey, migrant workers have been harmed in the working time, working conditions and remuneration and other interests, while migrant workers fear of losing jobs, high cost of rights, rights of the lack of knowledge and rights consciousness and other factors raise awareness of the rights of migrant workers. Therefore, we should wake up and improve the sense of rights protection of migrant workers in cities, and provide a good institutional environment for safeguarding rights, so that we can really change the status of the rights and interests of migrant workers and achieve their transformation to modern citizens. How to improve the awareness of the rights of migrant workers, many domestic scholars when discussing this issue more by the relevant government agencies to expand rights strength to help migrant workers, but ignore the object of education, focusing on education, training of migrant workers labor rights awareness should be more labor rights of migrant workers education activities.
