多学科视角下的混合所有制职业院校属性论

【摘要】：属性问题是混合所有制职业院校学院办学的根本问题。因为混合所有制职业院校办学实践中遇到的诸多问题或多或少均涉及其属性问题。对混合所有制职业院校属性问题认识不清,则很容易导致对其理解上的偏差,继而引发其办学实践的混乱。和其他事物一样,混合所有制职业院校的属性也是多方面的。基于产权经济学视角所理解的混合所有制职业院校的办学属性(所有权属性)则表现为国有资本的主导性,不同所有制性质资本结构的多元性和开放性;基于哲学(唯物辩证法)视角所理解的混合所有制职业院校的功能属性则表现为"非营利"和"营利"二者的兼容性;基于民法学视角所理解的混合所有制职业院校法人属性则应该归类为非营利性法人中的"事业单位法人"。
[Abstract]:Attribute problem is the fundamental problem of mixed ownership vocational colleges. Many problems encountered in the practice of mixed ownership vocational colleges are more or less related to their attributes. If we do not understand the attributes of the mixed ownership vocational colleges, it will easily lead to the deviation of their understanding and lead to confusion in the practice of running their schools. As with other things, mixed ownership of the attributes of vocational colleges is multifaceted. Based on the angle of view of property right economics, the school running attribute (ownership attribute) of the mixed ownership vocational colleges is shown as the leading role of the state-owned capital, and the diversity and openness of the capital structure of different ownership nature. The functional attributes of mixed ownership vocational colleges based on philosophy (materialist dialectics) are the compatibility of "non-profit" and "profit-making". On the basis of the view of civil law, the legal person attribute of the mixed ownership vocational college should be classified as the "institution legal person" among the non-profit legal persons.
