农地确权中政府目标与乡土惯习的冲突与调适——以江西A村为例

【摘要】：新一轮农地确权的政府目标是为了实现对农地的简单标准化管理,强化对农地的产权规制,推动对农地的流转和规模经营,但却与乡村长期存在的乡土惯习产生了冲突。这些乡土惯习主要体现在土地分配方式复杂模糊、土地关系注重乡土礼俗、土地经营关注家庭生计三方面。鉴于当前自上而下推行的农地确权使村集体失去了对土地的处置权利,带有强制性的行政手段忽略了地方差异和村民需求,政府应由农地确权的管理者变为服务者,依照相关法律法规,只确定农村集体土地所有权的边界,让农地确权成为村庄内部集体决策的结果,允许区域差异性的存在,实现政府目标和乡土惯习在权力层面的衔接,创造现代和传统的互动空间。
[Abstract]:The aim of the new round of government is to realize the simple standardized management of farmland, strengthen the regulation of farmland property rights, promote the circulation and scale management of agricultural land, but conflict with the long-standing rural habits. These local habits are mainly reflected in the complicated and fuzzy land distribution mode, the land relationship pays attention to the local customs and customs, and the land management pays attention to the family livelihood. In view of the fact that the current top-down ownership of agricultural land has deprived the village collective the right to dispose of the land, and the compulsory administrative means have ignored the local differences and the villagers' needs, the government should change from the manager of the rural land to a service provider. According to the relevant laws and regulations, only the boundary of the rural collective land ownership is determined, so that the rural land ownership becomes the result of collective decision-making within the village, allowing the existence of regional differences, and realizing the connection between the government goal and the local custom at the level of power. Create an interactive space between modern and traditional.
