欠发达山区农村集体建设用地流转模式研究

【摘要】：社会经济发展水平的提高,以及城镇化和工业化进程的加速推进,推动着集体建设用地大量流转。集体建设用地流转在盘活存量集体建设用地、提高建设用地利用率、改善乡村环境、增加农村收入等方面取得的成绩得到社会的认可,但集体建设用地流转与现行土地管理相关法律法规不相符合、无序混乱、大量矛盾纠纷等问题也引起了广泛的关注,广大专家和学者提出了大量的改进建议,构建了多种流转模式,但由于地区的差异性,这些建议和模式并不能普遍适用,因此,从地方实际出发研究农村集体建设用地流转模式,探索合乎地方实际的流转模式具有重大的现实意义。本研究以贵州省为例,探讨该地区集体建设用地流转的典型模式。首先,通过学习和研究前人的研究成果,明确了相关概念,确定了研究思路和研究内容;其次,运用分层随机抽样和典型抽样法在欠发达的贵州省选取样本区开展实地调查,掌握到贵州省集体建设用地流转现状呈现出五大特征;通过整理调研资料,总结提炼出四种典型的流转模式:村委会办公用地出租模式、“间歇性民宅出租”模式、“村庄城镇化”模式、“宅基地使用权抵押贷款”模式,详述其基本做法、资源配置效应与不足之处;从外部环境、面临的现实问题、取得的成绩、政府与市场的关系、流转动因、政策支撑等多方面对四种模式进行对比分析,提出了优化模式的措施;最后,选择“民宅开发”模式在贵州省内推广,以期更好地规范流转尤其是隐性流转。
[Abstract]:The improvement of social and economic development and the acceleration of urbanization and industrialization promote the mass circulation of collective construction land. The achievements of collective construction land circulation in activating the stock of collective construction land, improving the utilization rate of construction land, improving the rural environment, increasing rural income and so on have been recognized by the society. However, the circulation of collective construction land is not in accordance with the relevant laws and regulations of the current land management, disorder, a large number of contradictions and disputes and other issues have also aroused widespread concern, the vast number of experts and scholars have put forward a large number of suggestions for improvement. Many kinds of circulation models have been constructed, but because of the regional differences, these suggestions and models can not be universally applied. Therefore, this paper studies the rural collective construction land transfer model from the local reality. It is of great practical significance to explore the circulation mode in line with the local reality. This study takes Guizhou Province as an example to discuss the typical model of collective construction land transfer in this area. First of all, by studying and studying the previous research results, the related concepts are defined, and the research ideas and research contents are determined. Secondly, the stratified random sampling and the typical sampling method are used to carry out field investigations in the selected sample areas of less developed Guizhou Province. Mastering the current situation of collective construction land transfer in Guizhou Province presents five characteristics; through sorting out the survey data, summarizes and abstracts four typical circulation modes: the village committee office space rental mode, the "intermittent residential house rental" mode, The model of "village urbanization", "mortgage loan of the right to use the homestead", describes its basic practice, the effect of resource allocation and its inadequacies, from the external environment, the realistic problems, the achievements, the relationship between the government and the market, and the relationship between the government and the market. This paper compares and analyzes the four modes from the aspects of circulation motivation and policy support, and puts forward the measures to optimize the mode. Finally, the author chooses the "residential house development" mode to be popularized in Guizhou province in order to better standardize the circulation, especially the recessive circulation.
