农村建设性用地的产权结构与配置指向

【摘要】:我国农村建设性土地的性质和权利归属长期模糊不清,致使农村土地从农业耕地向建设性用地的转化缺少制度约束和成本约束,日益稀缺宝贵的农村土地资源得不到有效保护,从而危及了我国耕地红线。由于没有确定明晰的产权和法定审批程序,农村建设性用地的形成、使用和流转状况较为混乱,无法通过市场化途径实现其价值。土地资源作为人类共同的生存环境和生产生活资源,内在地决定了其特有的公共属性,也决定了国家对土地资源的公共管理权。要把国家管理和市场配置的决定性作用有机结合,科学合理地界定农村建设性用地性质,建立规范严格的审批制度和产权交易登记制度,消除农村建设性用地入市的制度障碍,实行城乡土地同地同价,占补平衡、增减挂钩,才能促进农村建设性土地的合理利用和有效配置。
[Abstract]:The nature and ownership of constructive land in rural areas in China has long been ambiguous, resulting in the lack of institutional and cost constraints in the transformation of rural land from agricultural arable land to constructive land, and the increasingly scarce and valuable rural land resources can not be effectively protected. Thus endangering the red line of cultivated land in China. Due to the lack of clear property rights and legal examination and approval procedures, the formation, use and circulation of constructive land in rural areas are confused, and their value can not be realized through market-oriented approaches. Land resources, as the common living environment and production and living resources of human beings, have determined their unique public attributes and the public management right of the country to the land resources. It is necessary to organically combine the decisive role of state management and market allocation, scientifically and reasonably define the nature of rural constructive land use, establish a standardized and strict examination and approval system and a registration system for property rights transactions, and eliminate the institutional barriers to the entry of rural constructive land into the market. The rational use and effective allocation of constructive land in rural areas can be promoted only by implementing the same price of urban and rural land, taking up the balance of compensation, and linking the increase and decrease.
