新一轮农地产权制度改革的政策学分析

【摘要】：农地产权制度是一个国家在法律上对农村土地产权结构和产权关系的制度安排,是农村土地制度的核心。农地产权制度改革涉及9亿农民的直接利益,关系到“三农”问题的顺利解决,而且从根本上影响着农村生产力的发展,影响着我国农村的政治稳定与社会和谐发展。党的十七届三中全会开启了新一轮农地产权制度改革。在十七届三中全会《中共中央关于推进农村改革发展若干重大问题的决定》的指引下,全国各地新一轮农地产权制度改革进行了卓有成效的探索和实践。然而,改革实践中也遇到各种各样的问题和矛盾。党的十八届三中全会发出了“深化改革”的号召,明确提出了要“赋予农民更多财产权利”。新一轮农地产权制度改革再度成为当今社会的热点话题。新一轮农地产权制度改革的的出发点是破解农民收入过低和农村经济发展缓慢的难题,并期望能构建和谐社会。本文运用公共政策分析的相关理论和方法,研究和分析我国新一轮农地产权制度改革的实践发展和现存的主要问题,探寻健全和完善我国新一轮农地产权制度改革的决策、执行和监督体制。本文首先界定了新一轮农地产权制度改革的相关概念,归纳新一轮农地产权制度改革产生的理论背景和现实背景,梳理新一轮农地产权制度改革的历史演变过程,然后,本文运用公共政策分析的相关概念框架和分析工具,对新一轮农地产权制度改革的政策制定,政策执行和政策监督进行系统阐述,并对湖南省益阳市草尾镇和永州市东安县两个区域的新一轮农地产权制度改革的实施情况进行实证分析,肯定了改革的显著成效,同时也总结出新一轮农地产权制度改革所面临的问题和挑战。如:政策决策体系不科学,政策执行不力以及缺乏有效的监督体系等。最后,根据以上的讨论和分析,提出了深化新一轮农地产权制度改革应遵循公平与效率、尊重农民意愿和坚守改革底线等原则,同时提出了“渐进式改革”的路径选择,进而对深化新一轮农地产权制度改革的过程中完善公共政策的决策、执行和监督体制提出了一些具有现实针对性的政策建议。
[Abstract]:The farmland property right system is the legal system arrangement of the rural land property right structure and the property right relation in a country, and it is the core of the rural land system. The reform of farmland property right system involves the direct interests of 900 million farmers, which is related to the smooth solution of the problem of "three rural areas", and affects the development of rural productive forces fundamentally, the political stability and the harmonious development of our country's rural areas. The third Plenary session of the 17th CPC Central Committee opened a new round of reform of farmland property rights system. Under the guidance of the third Plenary session of the 17th CPC Central Committee on the decision of the CPC Central Committee to promote the reform and development of rural areas, a new round of reform of the farmland property right system in various parts of the country has been carried out fruitful exploration and practice. However, the practice of reform also encountered a variety of problems and contradictions. The third Plenary session of the 18th CPC Central Committee issued a call for "deepening reform" and clearly proposed to "grant more property rights to farmers." A new round of farmland property system reform has become a hot topic in the society. The starting point of the new round of reform of farmland property right system is to solve the problems of low income of farmers and slow development of rural economy, and hope to build a harmonious society. Using the relevant theories and methods of public policy analysis, this paper studies and analyzes the practical development and existing main problems of the new round of farmland property right system reform in China, and probes into the decision of perfecting and perfecting the new round of farmland property right system reform in our country. Implementation and monitoring system This paper first defines the related concepts of the new round of farmland property right system reform, sums up the theoretical background and realistic background of the new round farmland property right system reform, combs the historical evolution process of the new round farmland property right system reform, and then summarizes the historical evolution process of the new round farmland property right system reform. Using the relevant conceptual framework and analytical tools of public policy analysis, this paper systematically expounds the policy formulation, policy implementation and policy supervision of the new round of farmland property right system reform. The paper also makes an empirical analysis on the implementation of the new round of farmland property right system reform in the two areas of Caowei Town, Yiyang City, Hunan Province, and Dong'an County, Yongzhou City, and affirms the remarkable effect of the reform. At the same time, it also summarizes the problems and challenges faced by the new round of farmland property right system reform. For example: the policy decision system is unscientific, the policy implementation is weak and lacks the effective supervision system and so on. Finally, based on the above discussion and analysis, this paper puts forward the principles of fairness and efficiency, respect for farmers' will and adherence to the bottom line of reform in order to deepen the reform of the new round of farmland property rights system. At the same time, it puts forward the path choice of "progressive reform". Furthermore, some practical policy suggestions are put forward to perfect the decision-making, implement and supervise the public policy in the process of deepening the reform of the farmland property right system.
