修水县黄溪村与安义县承包地经营权流转实践的比较研究

【摘要】:在农村土地所有权、承包权和经营权“三权分置”的基础上,促进土地经营权流转,是协调我国家庭承包责任制下分散承包与现代农业规模经营之间矛盾的必由之路,也是推进城乡一体化发展的内在要求。多年以来,围绕耕地承包经营权的流转,不少地方结合自身地域特征,因地制宜地开展了实践探索,实践需求是创新的源动力,来自基层的实践探索有很明确的针对性,具有较强的生命力和适用性。修水县黄溪村的“确权确股不确地”流转和安义县依“土地专业合作社”流转是江西省两个典型的耕地承包经营权流转实践探索,通过对这两地实践探索的总结、归纳,对推动承包地经营权流转的政策制定具有积极的参考价值。研究主要采取座谈与问卷相结合方法,对修水县黄溪村和安义县的耕地经营权流转进行了深入调研,对两地流转方式在组织模式、实践成效与存在的问题等几个方面分别进行了阐述,在理论层面对两种方式的理论基础、理论可行性、两种方式的组织模式、优缺点分别进行了比较,同时对两种方式在农户对产权的认知、流转意愿、流转的基本情况、运行的成功经验等这些实践过程进行了对比分析,最后总结了两地流转实践对规范和推进我国承包地经营权流转的启示,并提出相应的对策建议。研究表明,修水县黄溪村的“确权确股不确权”流转和安义县依“土地专业合作社”流转,各具特色,在一定环境下,都表现出较强的生命力。文章最后提出完善我国耕地承包经营权流转的对策建议,首先要坚持依法、自愿、土地用途不改变、考虑受让方的经营能力、明确本集体经济组织的优先权的原则;其次是完善现有法律法规的不足、明晰农村土地产权状况;第三是要加快中介组织的培育、推进土地流市场的建设;第四是要因地制宜的使用土地流转模式,并进一步创新;第五是要摆正政府的位置,壮大基层经济组织;第六是通过培育多种农业经营主体,保障耕地流转的可持续发展;第七是创新农村土地整治整合,适当推广确权确股不确地和专业合作社的流转方式。
[Abstract]:On the basis of rural land ownership, contract right and management right, promoting the circulation of land management right is the only way to coordinate the contradiction between decentralized contract system and modern agricultural scale management under the household contract responsibility system in our country. It is also the internal requirement of promoting the development of urban and rural integration. Over the years, around the transfer of the right to contract management of cultivated land, many places have carried out practical exploration according to their own regional characteristics. The practical demand is the source of innovation, and the practical exploration from the grass-roots level has very clear pertinence. It has strong vitality and applicability. The transfer of "ascertained right shares" in Huangxi Village, Xiushui County, and the transfer of land specialized cooperatives in Anyi County are two typical practical explorations on the transfer of the right to contract management of cultivated land in Jiangxi Province. It has positive reference value for the policy making of promoting the circulation of management right of contracted land. The research mainly adopts the method of discussion and questionnaire to investigate deeply the transfer of the management right of cultivated land in Huangxi Village and Anyi County of Xiushui County. Several aspects, such as practical effect and existing problems, are expounded respectively. The theoretical basis, theoretical feasibility, organization mode, advantages and disadvantages of the two methods are compared in theory. At the same time, the paper makes a comparative analysis of the two ways in the process of farmers' cognition of property right, their willingness to transfer, the basic situation of circulation, the successful experience of operation, and so on. Finally, the author summarizes the enlightenment of the practice of the two transfer to standardize and promote the circulation of the management right of contracted land in China, and puts forward the corresponding countermeasures and suggestions. The research shows that the circulation of "confirming right is not certain right" in Huangxi Village of Xiushui County and that of Anyi County in accordance with "Land specialized Cooperative" have their own characteristics and strong vitality under certain circumstances. Finally, the article puts forward the countermeasures and suggestions to improve the circulation of the contracted management right of cultivated land in China. Firstly, we should adhere to the principle of law, voluntarily, not change the land use, consider the management ability of the transferee, and make clear the principle of the priority of the collective economic organization. The second is to improve the existing laws and regulations to clarify the status of rural land property rights; the third is to speed up the cultivation of intermediary organizations to promote the construction of land flow market; the fourth is to adapt to local conditions of the use of land circulation model and further innovation; The fifth is to correct the position of the government to strengthen the grass-roots economic organizations, and the sixth is to ensure the sustainable development of cultivated land circulation through the cultivation of a variety of agricultural operators. The seventh is to innovate the rural land renovation and integration, to properly promote the right of the transfer of the right and professional cooperatives.
