构建我国农民财产权利体制研究

【摘要】：赋予农民更多财产权利,是实现城乡居民财产权利平等的必然要求。农民财产权利的不足,严重制约农户财富的培育、积累、扩大,制约农户财产进入社会财产增值体系、信用体系、流动体系,制约农民同城镇居民在经济权利上的平等,制约城乡一体化发展。 农民财产权利包括土地承包经营权、宅基地使用权、集体收益分配权。本文分析了土地承包经营权存在的流转困难、市场机制不完善、入股困难等问题,宅基地使用权存在的闲置与浪费、无法自由流转、抵押困难等因素,集体收益分配权存在的成员资格界定不明、分配不公、救济薄弱等问题,接着分析美国、德国、日本三国财产权体制上的成功之处。 构建农民财产权利体制,首先结合我国的实际情况提出了完善农民财产权利制度,从法律、组织、司法、执法等方面提出了具体的完善措施。其次结合我国的实际情况从农民财产权利的土地承包经营权、宅基地使用权、集体收益分配权等三个方面提出了具体的健全农民财产权利体制的措施。健全农村土地承包经营权体制上丰富和完善农村土地承包经营权内容,确立完善的农村土地所有权制度,完善对农村土地承包经营权流转方式的规定等。健全宅基地体制上规范宅基地使用权管理体制,加大执行监督力度、完善责任落实制度,建立规范有序的宅基地流转制度等。健全集体收益分配权体制上确立分配正义的理念、改革农村集体经济组织产权制度、确立以民事诉讼化解集体经济组织收益分配纠纷等。
[Abstract]:Giving farmers more property rights is an inevitable requirement to realize the equality of property rights between urban and rural residents. The deficiency of peasants' property rights seriously restricts the cultivation, accumulation and expansion of farmers' wealth, restricts their access to social property appreciation system, credit system, flow system, and restricts the equality of economic rights between peasants and urban residents. Restrict the development of urban and rural integration. Farmers' property rights include the right to contract land management, the right to use homestead, and the right to distribute collective income. This paper analyzes the problems of the circulation of the land contractual management right, the imperfect market mechanism, the difficulty of acquiring shares, the idleness and waste of the right to use the homestead, the lack of free circulation, the difficulty of mortgage, and so on. The definition of membership of the collective income distribution right is unclear, the distribution is unfair, and the relief is weak. Then the paper analyzes the success of the property rights system of the United States, Germany and Japan. In order to construct the system of peasants' property rights, this paper first puts forward the perfection of the system of peasants' property rights according to the actual situation of our country, and puts forward some concrete measures to perfect the system from the aspects of law, organization, judicature, law enforcement and so on. Secondly, combining with the actual situation of our country, this paper puts forward concrete measures to perfect the system of peasants' property rights from three aspects: the right to contract and manage the land, the right to use the homestead, and the right to distribute the collective income. Improve the system of rural land contractual management rights to enrich and improve the content of rural land contractual management rights, establish a sound system of rural land ownership, improve the circulation of rural land contractual management rights, and so on. The management system of the right to use the homestead should be standardized in the homestead system, the enforcement and supervision should be strengthened, the responsibility system should be perfected, and the circulation system of the homestead should be established. In order to perfect the system of collective income distribution, the concept of distribution justice should be established, the property right system of rural collective economic organizations should be reformed, and the disputes of income distribution of collective economic organizations should be resolved by civil action.
