公共治理视角下崇左市渔业资源管理研究

【摘要】：进入21世纪以来,随着我国渔业经济的快速发展,人们对于渔业产品的需求与日俱增,由于捕捞强度过大,渔业生态环境不断遭到破坏,渔业资源已经日渐衰退,如何才能通过科学的渔业资源管理来保持资源的可再生性,控制渔业酷渔滥捕的行为,实现渔业资源的合理开发和有效保护等问题逐渐受到人们的关注。人们对于渔业资源管理的探讨一直在不断加深,有从生物学范畴的管理到经济学、社会学范畴的管理研究；有从管理的法律体制、管理的方法和手段到管理的模式的研究。其中,国外多元化管理主体共同研究的管理模式非常值得我们借鉴。本文以崇左市的渔业资源管理为例,从公共治理的基本理论出发,剖析了崇左渔业管理发展现实存在的问题及其原因,评估了渔业管理制度和措施的执行效果。由于缺少一个完善的管理机制,再加上政府作为唯一的主管部门有限的管理能力,致使渔业资源一直得不到很好的保护。本文首先通过对国内外渔业资源管理的研究综述入手,根据国内外的研究现状揭示渔业资源管理的发展趋势,继而介绍了公共治理的理论背景和主要内容及其发展的趋势,提出了渔业资源管理的公共治理视角。紧接着通过实地调研分析崇左市渔业管理存在的困境,主要表现在：1、渔业资源管理的法律体系不完善,地方政府管理缺乏相关的法律依据,管理的执行力度不够；2、地方渔业资源管理制度的不健全,缺少相关制度的实施和相应政策的制定,公共事件发生的处理机制欠缺等等；3、渔业管理主体单一,仅仅让政府作为渔业资源的管理主体,容易出现管理人员不足,监管不到位,政府公共物品供给不足的缺点；4、政府公共服务薄弱,对于渔民的管理不到位,渔民素质偏低,酷渔滥捕行为屡禁不止。本文的重点是提出对渔业资源管理问题的解决途径,根据渔业资源的公共属性,从完善渔业法律体系、加强政府治理、成立渔业组织共同监管到政府一渔业组织-渔民群众共同参与资源管理等四个方面进行建议,旨在揭示渔业资源管理的趋势由分散型转向统一、再由单一转向多元化发展,在多元主体的共同监管下,进一步增强渔民对渔业资源的保护意识,改善渔民与政府的关系,切实推进渔业资源的可持续发展。
[Abstract]:Since the beginning of the 21st century, with the rapid development of fishery economy in China, the demand for fishery products has been increasing day by day. Due to the excessive intensity of fishing, the ecological environment of fisheries has been destroyed, and the fishery resources have been declining day by day. How to maintain the renewability of resources, control the overfishing behavior of fisheries and realize the reasonable exploitation and effective protection of fishery resources by scientific management of fishery resources has been paid more and more attention. The discussion on fishery resource management has been deepening, from the management of biology to economics and sociology, from the legal system of management, the methods and means of management to the model of management. Among them, the foreign diversified management subject common research management mode is very worthy of our reference. Taking the fishery resource management of Chongzuo City as an example, this paper analyzes the problems and reasons of the development of Chongzuo fisheries management from the basic theory of public management, and evaluates the implementation effect of fishery management system and measures. Due to the lack of a sound management mechanism, coupled with the limited management capacity of the government as the sole authority, fisheries resources have not been well protected. This paper firstly summarizes the research of fishery resource management at home and abroad, reveals the development trend of fishery resource management according to the current research situation at home and abroad, and then introduces the theoretical background, the main contents and the development trend of public governance. This paper puts forward the perspective of public management of fishery resources management. Then through the on-the-spot investigation and analysis of Chongzuo city fishery management dilemma, mainly manifested in: 1, fisheries resources management legal system is not perfect, local government management lack of relevant legal basis, management of the implementation of the intensity is not enough; (2) the imperfect management system of local fishery resources, the lack of the implementation of relevant system and the formulation of corresponding policies, the lack of handling mechanism of public events, and so on; 3, the fishery management subject is single, just let the government as the fishery resources management main body, easy to appear the management personnel shortage, the supervision is not in place, the government public goods supply insufficient shortcoming; 4. The government's public service is weak, the management of fishermen is not in place, the quality of fishermen is on the low side, and the overfishing behavior is prohibited repeatedly. The focus of this paper is to put forward a solution to the problem of fisheries resources management, according to the public nature of fishery resources, from improving the legal system of fisheries, strengthening the governance of the government, In order to reveal the trend of fishery resources management from decentralized to unified, and then from single to diversified development, the establishment of fisheries organizations to supervise and control together the government-fishery organizations-fishermen's masses to participate in the management of resources and other four aspects of the proposal, and so on. Under the supervision of multiple subjects, the consciousness of fishery resources protection should be further strengthened, the relationship between fishermen and government should be improved, and the sustainable development of fishery resources should be promoted.
