临汾市建筑业农民工权益保障研究

【摘要】：建筑业作为劳动密集型行业,其在社会经济的发展和城乡建设中占着至关重要的作用。该行业的农民工,往往从事着这个社会上最为艰难、沉重和脏苦累的工作,他们的付出,使得我们的社会经济发展和城市建设得以高速发展和日趋繁荣。但是,和他们做出的贡献相比,很多时候我们却无法为其提供良好的保护,保护其合法权益。比如,很多农民工的工资被拖欠,无法按时被支付,甚至会出现其老板携款潜逃,导致农民工工作了整整一年却无分文收益的情况。此外,农民工普遍生活环境差,工作条件艰苦,甚至在劳动的时候无法得到合适的保护,还要加班加点超时超强度劳动。此种情况下,农民工的生活处境越加糟糕,农民工权益保护也遥遥无期。但是,我们又必须要重视这个特殊群体的权益保护,虽然这项任务任重道远,但是我们仍旧要对其进行克服,因为农民工也生活在城市中,是城市生活圈的一部分,他们是城市中的弱势群体,如果对其不能良好保护,最终城市发展和社会和谐也会受到影响。对这一特殊群体如何进行正确定位,如何最大限度的保护他们的的合法权益,又如何有效利用有限的资源,并有针对性的为他们提供行之有效的服务和管理,这些一直是政府管理方面面临的严峻问题。本文以问卷的方式对临汾市建筑业农民工的权益保障现状进行了调查,以临汾市建筑业农民工调查的数据分析为切入点,分析临汾市建筑业农民工工作和生活状况。对临汾市建筑业农民工权益保护的现状进行归纳,并从劳动权合同签订率、维权意识低、工资拖欠等方面总结了临汾市建筑业农民工权益保障中存在的问题。从就业环境不规范、法制制度不健全、农民工自身原因三个方面对临汾市建筑业农民工的权益保障问题进行总结。建筑业农民工权益保障是一个漫长的过程,需要多方的共同努力。通过本文研究,得出以下研究结论:对临汾市建筑业农民工权益的保障,应当从如下三个方面展开:完善规范就业环境、构建多层次的法律保障体系、提升建筑行业农民工的综合素质。
[Abstract]:As a labor-intensive industry, construction plays an important role in social and economic development and urban and rural construction. Migrant workers in this industry are often engaged in the most difficult, heavy and dirty and tired work in this society. their efforts make our social and economic development and urban construction develop at a high speed and prosper day by day. However, compared with their contributions, we are often unable to provide good protection and protect their legitimate rights and interests. For example, many migrant workers are in arrears and can not be paid on time, and even their bosses will flee with the money, resulting in migrant workers working for a whole year without a penny. In addition, migrant workers generally live in a poor environment, working conditions are difficult, even in the labor can not get the right protection, but also overtime overwork. In this case, the living situation of migrant workers is getting worse and worse, and the protection of migrant workers' rights and interests is far from expected. However, we must attach importance to the protection of the rights and interests of this special group, although this task has a long way to go, but we still have to overcome it, because migrant workers also live in the city, is a part of the urban life circle, they are the vulnerable groups in the city, if they can not be well protected, urban development and social harmony will also be affected. How to position this special group correctly, how to protect their legitimate rights and interests to the maximum extent, how to make effective use of limited resources, and how to provide them with effective services and management have always been serious problems in government management. This paper investigates the present situation of the protection of the rights and interests of migrant workers in the construction industry of Linfen City by questionnaire, and analyzes the working and living conditions of migrant workers in the construction industry of Linfen City based on the data analysis of the survey of migrant workers in the construction industry in Linfen City. This paper sums up the present situation of the protection of the rights and interests of migrant workers in the construction industry in Linfen City, and sums up the problems existing in the protection of the rights and interests of migrant workers in the construction industry in Linfen City from the aspects of the signing rate of labor rights contracts, the low awareness of safeguarding rights and interests, and the arrears of wages. This paper summarizes the protection of the rights and interests of migrant workers in the construction industry of Linfen City from three aspects: the non-standard employment environment, the imperfect legal system and the causes of migrant workers themselves. The protection of the rights and interests of migrant workers in the construction industry is a long process, which needs the joint efforts of many parties. Through this study, the following research conclusions are drawn: the protection of the rights and interests of migrant workers in Linfen construction industry should be carried out from the following three aspects: perfecting and standardizing the employment environment, constructing a multi-level legal security system, and improving the comprehensive quality of migrant workers in the construction industry.
