中俄合同文本语言对比及翻译语言偏误分析

【摘要】：合同是当事人或当事双方之间设立、变更、终止民事关系的协议。依法成立的合同,受法律保护。广义合同指所有法律部门中确定权利、义务关系的协议。狭义合同指一切民事合同。还有最狭义合同仅指民事合同中的债权合同。随着经济全球化的发展,中国和俄罗斯在经济上的合作越来越密切,两个国家经济合作的历史悠久,合作范围更加广泛,合同在其中扮演着重要的角色。但是与此同时,合同产生的纠纷也越来越多,由于合同属于公共应用文书的一种,在制定方面有自己的特点,笔者通过研究中国和俄罗斯的合同文本,主要是双边贸易合同,分析比较两个国家在合同文本语言上的差异,以及在使用过程中出现的实际偏误,总结中俄合同发展特点,有利于双方进一步加深对合同的了解,促进双边政治经济发展。本文的主要内容如下:绪论部分介绍了选题的缘由和意义,对中国和俄罗斯相关的文献进行了综述,介绍了前人的研究情况并且指出了应该继续研究的方面,最后说明了本文的研究内容和所采用的研究方法。第一章概述中国和俄罗斯对合同的界定,合同的种类和格式.。简要说明中国和俄罗斯法律对合同的界定,合同的概念。中俄合同标题有不同的构成方式,公章使用不同的颜色,但是主要部分没有明显的差别。第二章分析中俄合同的语言特点,包括词汇表达和语法表达两个方面。词汇表达分析了中俄合同中的常见文本词汇、缩略语、合同术语和专业词汇以及专有名词,比较了它们在中俄合同文本中的相同点和不同点,总结了它们的特征。语法表达分析了中俄合同文本中的关联词、量词以及句式特征,总结了合同的语体特点。第三章通过具体的例子说明中文合同中的翻译偏误以及改进的措施。将分为词汇偏误、句子偏误、篇章偏误三类,分析了中俄合同翻译偏误出现的原因。我们认为对合同的充分了解和对偏误的正确认识是解决翻译偏误的重要方式。本文旨在通过中俄合同文本语言对比研究以及翻译偏误分析,加深双方对合同文本在格式,语言以及使用等方面差异的认识,同时,也有助于学者进一步比较研究中俄合同。
[Abstract]:A contract is an agreement between the parties or parties to establish, modify, and terminate civil relations. Contracts established according to law shall be protected by law. A broad contract refers to an agreement that defines the relationship between rights and obligations in all legal departments. Narrow contract refers to all civil contracts. There is also the narrowest contract only refers to the civil contract in the creditor's rights contract. With the development of economic globalization, the economic cooperation between China and Russia is getting closer and closer. The economic cooperation between the two countries has a long history and a wider scope of cooperation, in which contracts play an important role. But at the same time, there are more and more disputes arising from contracts. As contracts are a kind of public application instruments, they have their own characteristics in the formulation. By studying the contract texts of China and Russia, mainly bilateral trade contracts, This paper analyzes and compares the differences between the two countries in the text of the contract and the actual errors in the process of use, and summarizes the characteristics of the development of the contract between China and Russia, which is conducive to further deepening the understanding of the contract between the two countries and promoting the bilateral political and economic development. The main contents of this paper are as follows: the introduction part introduces the reason and significance of the topic, summarizes the relevant literature of China and Russia, introduces the previous research situation and points out the aspects that should be continued. Finally, the research content and the research methods adopted in this paper are explained. The first chapter gives an overview of the definition, types and format of contracts in China and Russia. Briefly explain the definition of contract and the concept of contract in Chinese and Russian law. The title of the contract between China and Russia is composed in different ways, and the seal uses different colors, but there is no obvious difference in the main parts. Chapter two analyzes the linguistic features of Sino-Russian contract, including lexical expression and grammatical expression. This paper analyzes the common text words, abbreviations, contract terms, professional terms and proper nouns in Chinese and Russian contracts, compares their similarities and differences in Chinese and Russian contract texts, and summarizes their characteristics. The grammatical expression analyzes the features of the relevant words, quantifiers and sentence patterns in the contract texts of China and Russia, and summarizes the features of the contract style. Chapter three illustrates the translation errors in Chinese contracts and the measures to improve them. It is divided into three categories: lexical error, sentence error and textual error. We believe that full understanding of contracts and correct understanding of errors are important ways to solve translation errors. The purpose of this paper is to deepen the understanding of the differences in format, language and use of contract texts between China and Russia through the contrastive study of Chinese and Russian contract texts and the analysis of translation errors. At the same time, it is helpful for scholars to make further comparative study of Sino-Russian contracts.
