【摘要】："专利流氓"是现代社会新型的、高智商流氓,专门以专利诉讼为要挟,向高科技公司实施敲诈,谋取暴利。"专利流氓"有着合法的维权外衣,但在道德价值取向上是一种恶。从行为动机上看,专利流氓动机不良;从行为过程来看,专利流氓有违社会正义;从行为结果来看,专利流氓破坏了市场正当竞争秩序,阻碍科技创新与应用,浪费社会资源,败坏社会风气。"专利流氓"的存在与疯长使得以激励创新为目标的专利制度正走向创新的对立面。虽然"专利流氓"目前盛行于西方欧美国家,我国并不具备滋长美国式专利流氓的制度,但我国仍具有诱发专利流氓制度与非制度因素,我们仍需要警惕专利流氓,防患于未然。
[Abstract]:"patent hooligan" is a new type of modern society, high intelligence hooligans, specially under the threat of patent litigation, extortion from high-tech companies to seek huge profits, "patent hooligans" has a legitimate protection coat. But the moral value orientation is a kind of evil. From the behavior motive, the patent hooligan motive is bad; From the behavior process, patent hooligans violate social justice; From the behavior results, patent hooligans undermine the order of fair competition in the market, hinder the innovation and application of science and technology, and waste social resources. The existence and growth of "patent hooligans" make the patent system aiming at encouraging innovation to be the opposite of innovation, although "patent hooligans" are prevalent in western countries at present. Our country does not have the system that nurtures the American type patent hooligan, but our country still has induces the patent hooligan system and the non-system factor, we still need to guard against the patent hooligan, prevents the problem in the early stage.
