对精神障碍患者的非自愿收治:作为一个伦理问题

【摘要】：对精神障碍患者进行非自愿收治是一个富有争议的问题,它体现了公共利益和个体权利、医学模式和公民自由、家长主义和个体自主等不同价值间的矛盾和冲突。本文从伦理学的角度,结合我国精神卫生立法的历史和现状,对非自愿收治的合理性、非自愿收治的标准与程序等问题进行了论证。惟有建立以患者权利为导向的精神卫生体系,才能真正保障患者和社会公众的根本利益,避免精神病学非自愿收治的滥用。
[Abstract]:Involuntary treatment of people with mental disorders is a controversial issue that embodies the public interest and individual rights, medical models and civil liberties. The contradiction and conflict between different values such as paternalism and individual autonomy. From the angle of ethics and the history and present situation of mental health legislation in our country, this paper discusses the rationality of involuntary admission to hospital. Only the establishment of a patient's right oriented mental health system can truly protect the fundamental interests of the patient and the public and avoid the abuse of involuntary psychiatric treatment.
