论公民美德与全民守法的内在逻辑

【摘要】：公民美德与全民守法是公民社会和法治国家确立的基础要素,然而,长期以来的道德建设和普法宣传各行其道,效果并不明显。实际上,公民美德的培育与全民守法习惯的养成无论在"人"这一主体要素的归结点上,还是在核心内容的界定上都具有同质性(权利与义务、自由与责任)。更重要的是,公民美德的培育需要全民守法的制度环境,全民守法习惯的养成需要公民美德的彰显和支持,两者相互依存、相互促进。
[Abstract]:Civic virtue and law-abiding are the basic elements of the civil society and the country ruled by law. However, the effect of moral construction and law popularization is not obvious for a long time.In fact, the cultivation of civic virtue and the cultivation of the habit of abiding by the law of the whole people have homogeneity (rights and obligations, freedom and responsibility), not only in the resolution point of "human", but also in the definition of the core content.More importantly, the cultivation of citizen virtue needs the system environment of abiding by the law, and the cultivation of the habit of abiding by the law needs the demonstration and support of citizen virtue. The two are interdependent and mutually promote each other.
