刑讯逼供成因及对策研究

【摘要】： 刑讯逼供利用的是人对肉体痛感的本能恐惧，，物质性成本低；刑讯逼供罪的法定刑较低，刑罚惩罚力度不足；刑讯逼供犯罪发生在相对封闭的环境之内，侦查与羁押不分、较长的侦查羁押期限使该环境的封闭性得以延续，使对刑讯逼供犯罪的控制能力不足，因而导致刑讯逼供犯罪的惩罚性成本低；缺乏完善的非法证据排除规则，而使刑讯逼供的收益稳定。要遏制刑讯逼供犯罪，就必须增加其行为成本，降低其收益。
[Abstract]:Extorting confessions by torture uses people's instinctive fear of physical pain and low material costs; the legal punishment for the crime of extorting confessions by torture is relatively low and the punishment is insufficient; the crime of extorting confessions by torture takes place in a relatively closed environment, and the investigation is not separated from detention. The longer time limit of investigation and detention makes the environment continuous, the ability to control the crime of extorting confessions by torture is insufficient, which leads to the low punitive cost of the crime of extorting confessions by torture, and the lack of perfect exclusion rules of illegal evidence. And make the income of extorting confessions by torture stable. In order to curb the crime of extorting confessions by torture, we must increase its cost and reduce its income.
