【摘要】：本文从社区的概念、特征和功能出发,论述了社区犯罪防范体系的三大核心内容:社区建设、社区警务和社区矫正。社区防范是将社区建设、社区警务与社区矫正有机结合起来。因为,犯罪总是发生在一定的社区当中,直接的犯罪预防措施必须在社区建设中体现。有效地预防、打击、破获犯罪、抓捕犯罪分子必须依靠社区居民,走群众路线,依法推进有中国特色的社区警务战略,社区预防必须融入社区警务。对犯罪人的改造,如缓刑、假释、管制等,都需要社区居民的配合与监督,犯罪分子的再社会化也必须依靠社区。因此,只有有效实施社区矫正制度才能真正实现预防犯罪、减少犯罪。可以看出社区防范的三大核心内容之间具有相互依存、相互促进、相辅相成的密切关系。社区建设的主要内容包括社区组织建设,以及社区服务、社区卫生、社区环境、社区文化、社区治安等。社区建设具有重要的社会整合功能、社会控制功能、培养文明意识及促进社会稳定功能、整合社会资源预防违法犯罪功能、社会化和社会心理调节功能以及保持安定的治安环境。社区建设的独到功能使它成为社区预防犯罪的基础环节,是一切预防措施的基础和前提。社区警务战略要求警察必须立足社区,实行警民合作与社区共建,积极发动和组织社区居民,参与防范和打击犯罪,共同建立社区安全防护网络。社区是预防犯罪的基础和立足点,社区警察工作的重点是融入社区、为社区服务,发现社区安全建设的缺陷和社区内的各种致罪因素,将犯罪预防的重点放在犯罪发生之前发现各种致罪因素并予以科学的防范。社区警务理论要求社区警察与社区居民加强沟通和联系,使警务工作延伸到社区,创建警务工作与社区工作相结合的新的警务工作模式。社区矫正是一种在社区中对罪犯执行刑罚的制裁措施,对中国来说,社区矫正还处于试点阶段。我国对轻微罪犯采取社区矫正措施的主要原因在于监禁刑的弊端以及社区矫正措施的优势。坚实的社区工作基础、逐步完善的法制建设、科学技术的飞速发展、有关机关和领导的高度重视为开展社区矫正工作奠定扎实的基础,但由于方方面面的原因,我国的社区矫正制度远远不如西方发达国家完善。我们要结合新时期社会发展的要求,构建符合中国国情的新型的社区矫正工作模式和体系,从而实现社区预防犯罪的目的。
[Abstract]:Based on the concept, characteristics and functions of community, this paper discusses three core contents of community crime prevention system: community construction, community policing and community correction. Community prevention is an organic combination of community construction, community policing and community correction. Because crime always occurs in a certain community, direct crime prevention measures must be reflected in community construction. To effectively prevent, crack down and crack down on crime and arrest criminals must rely on community residents, follow the mass line, promote the strategy of community policing with Chinese characteristics according to law, and integrate community prevention into community policing. The reform of criminals, such as probation, parole and control, all need the cooperation and supervision of community residents, and the re-socialization of criminals must also depend on the community. Therefore, only the effective implementation of community correction system can truly achieve crime prevention and reduce crime. It can be seen that the three core contents of community prevention are closely related to each other, promoting each other and complementing each other. The main contents of community construction include community organization construction, community service, community health, community environment, community culture, community security and so on. Community construction has the important function of social integration, social control, cultivating civilization consciousness and promoting social stability, integrating social resources to prevent crime. Socialized and social-psychological regulation functions as well as maintaining a stable public security environment. The unique function of community construction makes it the basic link of community crime prevention and the foundation and premise of all preventive measures. The community policing strategy requires the police to base themselves on the community, to cooperate with the community, to actively mobilize and organize the community residents, to participate in preventing and cracking down on crime, and to jointly establish the community safety protection network. The community is the foundation and foothold of crime prevention, and the focus of community police work is to integrate into the community, serve the community, and discover the shortcomings of community safety construction and the various factors causing crime in the community, The focus of crime prevention is to find out all kinds of factors before the crime occurs and to prevent it scientifically. Community policing theory requires community police and community residents to strengthen communication and contact, make police work extend to the community, and create a new police work mode combining police work and community work. Community correction is a kind of punishment measure that carries out punishment to criminals in the community. For China, community correction is still in the pilot stage. The main reason of community correction for minor offenders in China lies in the disadvantages of imprisonment and the advantages of community correction measures. The solid foundation of community work, the gradual improvement of the legal system, the rapid development of science and technology, and the great importance attached by the relevant organs and leaders to the work of community correction lay a solid foundation, but for various reasons, Our country's community correction system is far less perfect than the western developed countries. According to the requirements of social development in the new period, we should construct a new mode and system of community correction in accordance with the national conditions of China, so as to achieve the purpose of community crime prevention.
