我国非公有制企业职务犯罪及其预防

【摘要】： 近年来,我国非公有制企业的地位和影响力日益增强,与此同时,我们也发现这些企业的职务犯罪问题同样日趋严重,急待我们对此做出探讨。在西方犯罪学中,这一领域的研究归属于白领犯罪学的范围。企业职务犯罪具有其自身的特殊性,这一领域的研究仍有许多值得发掘的地方。因此对企业职务犯罪问题进行研究我们认为是具有理论意义和现实意义的。另外,对于非公有制企业职务犯罪预防的研究,通常被认为是犯罪研究中最为重要的一环,因为在现象既存的情况下,寻找到其解决对策,也正是我们研究的目的。笔者采用“二元论”犯罪学理论,对企业职务犯罪的内因和外因分别进行分析,进而提出预防策略。
[Abstract]:In recent years, the status and influence of non-public enterprises in our country is increasing day by day. At the same time, we also find that the problem of duty crime in these enterprises is becoming more and more serious. In western criminology, the research in this field belongs to the scope of white-collar criminology. The enterprise duty crime has its own particularity, the research in this field still has many worthy to explore. Therefore, it is of theoretical and practical significance to study the problem of corporate duty crime. In addition, the study on the prevention of job-related crimes in non-public enterprises is usually regarded as the most important part of the crime research, because it is the purpose of our research to find the solutions to the problems existing in the existing phenomena. Based on the theory of dualism, the author analyzes the internal and external causes of corporate duty crime, and puts forward the preventive strategies.
