协商致“公”——基层协商民主与公共性的重建

【摘要】：中国社会从传统走向现代的过程中始终贯穿着公共性重建的根本命题,公共性阙如是当下社会治理面临的深层困境。发展基层民主是培育公共性的重要途径,公共性是协商民主的目标和"试金石",协商致"公"为两者的统一。公共性体现在个体、社会和国家这三个不同层面,基层协商可以按照是否涉及决策和决策权力主体划分为四种类型,它们在促进不同层面公共性的成长上作用也有所区别。基层协商的主体确定、议题选择、程序设计等环节均蕴含着公共性的载体发育及建构途径问题。新的公共性既保障个体权利和自由,又超越个人偏好,利益指向公共理性和公共利益。公共性的重建一方面需要国家权力更好地实现公共利益,另一方面也需要公民从私人领域迈向公共领域。
[Abstract]:Chinese society from the traditional to modern process has been running through the fundamental proposition of public reconstruction, lack of publicity is the current social governance of the deep dilemma, the development of grass-roots democracy is an important way to cultivate publicity. Publicity is the goal of negotiation democracy and "touchstone". Negotiation to "public" is the unity of the two. Publicity is embodied in three different levels: individual, society and country. Grass-roots consultation can be divided into four types according to whether or not decision-making and decision-making power subjects are involved, and their roles in promoting the growth of publicity at different levels are also different. The procedure design and other links all contain the public carrier development and the construction way question. The new publicity not only guarantees the individual right and freedom, but also surpasses the individual preference. On the one hand, the reconstruction of publicity needs the power of the state to realize the public interest better, on the other hand, it also needs citizens to move from the private sphere to the public sphere.
