城乡经济公正的法制构建研究

【摘要】：公正问题是现代社会最重要的问题之一,是建设社会主义和谐社会的基本要求和最终目标,在社会主义市场经济条件下,经济公正显得尤为重要。当前中国的城乡差距问题关系改革开放和现代化建设的全局,深刻地影响着整个国民经济和社会事业的发展,己经成为了制约中国经济发展的瓶颈性障碍。据最新的调查数据显示,截止目前中国城乡居民贫富差距正在不断扩大,收入最高10%群体和收入最低10%群体的收入差距,已从1988年的7.3倍上升到如今的23倍。①2010年的两会报告中明确指出,缩小城乡贫富差距要靠公平正义。实现公正是法的精神所在。而如何实现经济公正,正是法律所应解决的问题。法与经济公正有着天然的理论渊源,“法律来自正义就像来自它的母亲”。②法律制度的健全与否是经济公正能否实现的重要前提,因此,要解决城乡经济公正的问题,必须完善相关的法律制度。只有在法律保障的框架内,城乡经济公正才能真正得以实现。党的十七大提出统筹城乡发展的要求,在此背景之下,完善城乡经济法律保障体制的构建,对于实现城乡经济公正具有重要的现实意义。本文主要从以下三分部分对城乡经济公正的法制构建进行了研究:第一部分主要介绍城乡经济公正的理论概说,在此部分,界定了城乡经济公正的相关概念,提出了实现城乡经济公正所应遵循的原则,梳理了影响城乡经济公正的因素。第二部分,对我国现阶段城乡经济公正的现状及影响进行了分析。指出当前我国城乡经济公正面临的问题及其带来的一些列负面影响,分析阐明了实现城乡经济公正需要法律制度的保障。第三部分,主要阐述了城乡经济公正法制构建的路径选择,分别从立法理念、生存发展、产权制度和国民待遇等体系的构建,以及创设良好的法制环境等方面介绍了主要的路径选择。
[Abstract]:Justice is one of the most important problems in modern society, and it is the basic requirement and ultimate goal of building a harmonious socialist society. Under the condition of socialist market economy, economic justice is especially important. The current urban-rural gap in China, which is related to the overall situation of reform, opening up and modernization, has a profound impact on the development of the entire national economy and social undertakings, and has become a bottleneck obstacle that restricts the development of China's economy. According to the latest survey data, the gap between the rich and the poor of China's urban and rural residents is widening, with the income gap between the top 10% and the lowest 10%. It has risen from 7.3 times in 1988 to 23 times today. 1in the 2010 report to the National people's Congress, it was clear that fairness and justice were needed to narrow the gap between the rich and the poor in urban and rural areas. The realization of justice is the spirit of law. How to realize economic justice is the problem that the law should solve. There is a natural theoretical origin between law and economic justice. (2) whether the legal system is sound or not is an important prerequisite for the realization of economic justice. Therefore, it is necessary to solve the problem of urban and rural economic justice. We must perfect the relevant legal system. Only in the framework of legal protection, urban and rural economic justice can really be realized. The 17th National Congress of the Communist Party of China put forward the requirement of coordinating urban and rural development. Under this background, it is of great practical significance to perfect the legal guarantee system of urban and rural economy for the realization of urban and rural economic justice. This paper mainly studies the legal system construction of urban and rural economic justice from the following three parts: the first part mainly introduces the theory of urban and rural economic justice, in this part, defines the related concepts of urban and rural economic justice. This paper puts forward the principles to be followed in the realization of urban and rural economic justice, and combs the factors affecting urban and rural economic justice. The second part analyzes the current situation and influence of urban and rural economic justice in China. This paper points out the problems facing the urban and rural economic justice in our country and some negative effects it brings, and expounds that the realization of urban and rural economic justice needs the guarantee of the legal system. The third part, mainly expounds the path choice of urban and rural economic justice and legal system, respectively from the legislative concept, survival and development, property rights system and national treatment system construction. And the creation of a good legal environment and other aspects of the introduction of the main path choice.
