析全球化时代的国家行为——三种法治模式下的选择

【摘要】：全球化时代,国家行为不得不面对着国家法治、国际法治和全球法治三种法治模式共存的国际规范结构。三种法治模式的理念不同、内容不同、对国家行为的要求及规范各有不同,必将引发国家行为如何选择适用法律的问题。对此,国家行为应以利益平衡为现实出发点,以效力层次为优先适用法律的依据,以实质法治意义上的良法为选择法律的前提,以形式法治意义上的善治为选择"行为模式"的标准,以应对全球化发展的要求。
[Abstract]:In the era of globalization, state behavior has to face the international normative structure in which three modes of rule of law coexist: national rule of law, international rule of law and global rule of law.The different concepts and contents of the three modes of rule of law and the different requirements and norms of state behavior will inevitably lead to the problem of how to choose the applicable law for state behavior.In view of this, the act of state should take the balance of interests as the realistic starting point, take the level of validity as the basis for the first application of the law, and take the good law in the sense of substantive rule of law as the premise of choosing the law.In order to meet the demands of globalization, good governance in the sense of formal rule of law is the criterion of choosing "behavior mode".
