清代民间社会图赖现象之研究

【摘要】：清代民间社会存在着大量的“图赖”现象。尤其在经济相对发达的沿海地区更为普遍。图赖的方式大概有以老病之人图赖、妇女撒泼图赖、借路遇之尸图赖，甚至杀人图赖等。手段之奸伪刁诈另人咋舌。对此，，清律中专门设有禁止图赖的条例。因“图赖”与“威逼”在律例及现实中均相关甚深，本文在界定了“图赖”与“威逼”的法律关系的基础上，通过对大量图赖案件的分析，探讨了官府对图赖案件的处理方式及其对民众诉讼的影响。从而进一步揭示出了尸体被用来图赖这一现象之所以广泛存在的社会经济根源。
[Abstract]:There was a large number of phenomenon of Tulai in civil society in Qing Dynasty. Especially in the relatively developed coastal areas are more common. Tulai may be the old sick Tulai, women Sapo Tulai, through the road to the body of Tulai, and even murderous Tulai and so on. The deceit of the means is shocking. In this regard, the law of the Qing Dynasty has a specific prohibition of Tulai regulations. Because "Tulai" and "coercion" are closely related in law and practice, this paper, on the basis of defining the legal relationship between "Tulai" and "coercion", analyzes a large number of Turai cases. This paper probes into the way that the government deals with the Tulai case and its influence on the public litigation. Thus, the social and economic root of the phenomenon is revealed.
