【摘要】：清代刑部的堂司关系对刑部政务能否顺畅地进行专业化运作有着重要影响。其变化从堂司之间的礼仪反差中直观地表现出来。雍正以前,司官对堂官的依附性较小,礼仪亦较简略;乾隆以后,司官对堂官的依附性逐步加强,礼仪也越发隆重。堂司之间的工作交往以日常在部时的"说堂—画稿"和堂司数人同时钦差在外审案为两个主要途径。其中"说堂—画稿"的形式随着时代的变化而有所区别。乾隆时期,同司各官倾向于自由竞争,以"说堂"为契机博得堂官赏识;嘉庆、道光以后,司内明确了固定的掌印、主稿人选,逐渐向科层制转变。而"钦差办案"总体来说是堂司官员之间形成私交的终南捷径,但在特殊情况下也会带来一些麻烦。
[Abstract]:The relationship between the Tang and the Chief of the Criminal Department of the Qing Dynasty has an important influence on the smooth and professional operation of the administrative affairs of the Department of Criminal Justice. Its changes are directly and intuitively manifested in the contrast of etiquette between the monarchs. Before Yongzheng, the officials of the Department of Criminal Affairs were less dependent on the parish officials. The etiquette was also relatively simple; after Qianlong, the attachment of the department officials to the magistrate gradually strengthened. Etiquette is becoming more and more ceremonious. The main ways of working communication between church directors are "talking about Tang and drawing manuscripts" when they are in the ministry, and several members of the Tong Department are trying to judge outside at the same time. Among them, the form of "talking about Tang and drawing manuscripts" is changing with the times. In the Qianlong period, The officials of the same department tend to compete freely, and take the opportunity of "saying the hall" as an opportunity to win their appreciation; after Jiaqing, Daoguang, the division has made clear the fixed print, the main manuscript candidate, Gradually changing to the hierarchy of departments. And the "Chin Chao case" is, in general, a shortcut to the formation of private relations between church officials, but in special cases will also cause some trouble.
