秦迁刑考略

【摘要】：随着秦领土的不断扩张,具有实边意义的迁刑应运而生,且适用范围越来越广泛。迁刑作为秦的主要刑罚之一,为了满足实边的需要,在执行时,通常对其家庭集团施以包刑,一同迁往边地。在秦的刑罚体系中,迁刑与耐刑的刑罚序列相当,补充完善了秦死、刑、耐的三级刑名体系。
[Abstract]:With the continuous expansion of Qin's territory, the transfer penalty with real significance emerged as the times require, and the scope of application is more and more extensive. As one of the main penalties in Qin Dynasty, in order to meet the needs of the real border, the family group was usually executed with the punishment of contract and moved to the border area together. In the penalty system of Qin Dynasty, the transfer penalty is equal to the penalty sequence of penalty tolerance, which complements and perfects the system of three levels of death, punishment and endurance of Qin Dynasty.
