严复的政体观:以孟德斯鸠《法意》为中心

【摘要】:比照孟德斯鸠《论法的精神》的纳琴特英译本,严复关于政体三分法的译述不一,但总括以"民主"与"君主"两类。对三种政体所表现的精神,严复则译述为"民主以德"、"君主以礼"以及"专制以刑",然而对"德"、"礼"与"刑"的理解又是多样的。这就表明严复的翻译并不拘泥于原文,而是渗透着自己独到的理解。基于此,他还认为孟德斯鸠的政体学说是纲领性的论点,是趋于理想范型的;必须放置在古今流变的历史背景下来审视孟德斯鸠的政体学说;孟德斯鸠的政体学说并非放之四海而皆准,民主不过是一理想政体。
[Abstract]:Comparing with the English translation of Montesquieu's the Spirit of the Law, Yan Fu's translation of the Trilogy of the polity is divided into two categories: democracy and monarchy. Yan Fu interprets the spirit of the three regimes as "democracy with virtue", "monarch with courtesy" and "autocracy with punishment", but the understanding of "morality", "rite" and "punishment" is diverse. This shows that the translation of Yan Fu is not confined to the original text, but permeates its own unique understanding. Based on this, he also holds that Montesquieu's theory of polity is programmatic and tends to the ideal model, and must be placed in the historical background of ancient and modern changes to examine Montesquieu's theory of polity. Montesquieu's doctrine of polity is not universal. Democracy is but an ideal regime.
