罗尔斯正义概念探析

【摘要】：在西方现代政治哲学中,罗尔斯的哲学是一个重要的里程碑。本文从正义这一基本概念入手,旨在探讨罗尔斯正义理论的形成与发展过程,从正义的主题——社会基本制度出发,阐明了分配公民基本权利和义务的原则即正义原则,并重点论述了两个正义原则的推导过程。正义原则通过调节社会基本制度,从社会个体的微观角度出发,处理社会事实上的不平等现象。在一个纯粹假设的“原初状态”之中,罗尔斯规定相互冷淡的各方只保有一般的社会理论知识,其个人的特殊信息都掩盖在“无知之幕”之下,从而模拟有理性的个人进行合理的推理,并最终选择正义原则。
[Abstract]:In the western modern political philosophy, Rawls' philosophy is an important milestone. Starting with the basic concept of justice, this paper aims to discuss the formation and development of Rawls' theory of justice, and from the point of view of social basic system, clarifies the principle of distributing the basic rights and duties of citizens, that is, the principle of justice. The derivation process of the two principles of justice is discussed in detail. The principle of justice deals with the social inequality by adjusting the basic social system and from the microcosmic point of view of the social individual. In a purely hypothetical "primordial state," Rawls dictates that the cold parties retain only general knowledge of social theory, and that their personal special information is hidden under the "curtain of ignorance". Thus simulate rational individuals to reason reasonably, and finally choose the principle of justice.
