论人权价值的主体性

【摘要】：实现人权价值的主体性,是把握世界人权发展史的一条主线。从世界范围内来看人权价值的发展历程,其经历了从作为主体的个体价值到作为主体的社会价值,再从国家层面到国际层面对作为主体的人权价值保障的过程。在人权价值发展史上,由于对"人"的理解不同,西方某些资本主义大国固执于个人自由主义的价值表达,而一些发展中国家则强调社会发展价值的表达,导致了人权主体的个人价值与社会价值、自由价值与发展价值、普遍价值与特殊价值的冲突。中国人权价值在对世界人权价值发展史中三个基本问题反思的基础上,建立起中国社会主义主流价值取向和中华民族优秀传统文化价值取向相结合的人权价值新类型。这种自觉的构建活动在彰显人权价值主体性的同时,使中国人权价值为世界人权价值做出了重要贡献。
[Abstract]:The realization of the subjectivity of human rights value is one of the main lines in the development of human rights in the world. From the perspective of the world, the development of human rights value has gone through the process of the individual value as the subject to the social value as the main body, and the human rights value guarantee as the subject from the national level to the international level. In the history of human rights value, because of the different understanding of the "a man", some of the western capitalist countries are stubborn in the value expression of individual liberalism, while some developing countries emphasize the expression of the value of social development, which leads to the personal value and social value of the human rights main body. The conflict between the value of liberty and the value of development, the universal value and the special value. On the basis of the reflection of the three basic problems in the history of the world's human rights value, the human rights value of China has set up a new type of human rights value combined with the orientation of the mainstream value of China's socialism and the value orientation of the outstanding traditional cultural value of the Chinese nation. This self-conscious construction activity has made an important contribution to the human rights value of the world while demonstrating the subjectivity of human rights value.
