【摘要】：自然人网店是互联网经济时代发展的产物,因其灵活便捷的经营模式得到了迅速发展。自然人网店交易的兴起和普及,改变了人们的消费模式,对社会生活产生了巨大的影响,成为推动我国经济发展的重要力量。但自然人网店的交易制度,仍有许多不完善的地方亟待完善。本文以自然人网店交易制度的完善为中心,深入探讨自然人网店交易制度存在的问题,提出理论观点和完善建议。各章主要内容如下:第一章从自然人网店的不同分类出发,总结出自然人网店的概念,对其商事主体地位进行明晰,在此基础上论述自然人网店交易及其特殊性。第二章提出自然人网店交易制度的立法现状,并对其存在的主要问题进行分析:一是自然人网店的商主体制度问题,二是自然人网店交易行为规范的问题,三是责任承担问题,四是救济制度的问题。第三章选取了韩国、美国、欧盟三个主体的自然人网店交易制度进行研究,获取有关我国自然人网店交易制度完善的启示。第四章综述完善我国自然人网店交易制度的具体建议,对自然人网店的商主体问题、交易行为规范问题、责任承担以及相应救济制度的构建提出了全面系统、切实可行的完善建议。
[Abstract]:Natural person shop is a product of the Internet era, because of its flexible and convenient mode of operation has been the rapid development and popularization of the natural person. The rise of online trading, has changed people's consumption patterns, has a great impact on social life, become an important force in promoting China's economic development. But the natural person shop transaction system, there are still many imperfect places need to be improved. To improve the natural person shop trading system as the center, in-depth study of existing natural online trading system, put forward the theoretical viewpoints and suggestions. The main contents of each chapter are as follows: the first chapter is different from the natural person shop of classification, summed up the concept of nature. The shop, the main commercial position was clear, in this paper based on the natural person and the particularity of online trading. The second chapter put forward the law situation of natural person online trading system, And the main existing problems are analyzed: one is the main commercial system of natural person is a natural person shop, two shop trading behavior problems, three is the question of responsibility, four is a relief system. The third chapter selects the United States, South Korea, on three main EU natural person online trading the system for natural person in our country online trading system perfect enlightenment. The fourth chapter reviews the specific proposals to improve China's natural person online trading system, taking the subject of natural person shop, trading behavior, responsibility and the corresponding relief system construction put forward a comprehensive system, feasible suggestions.
