【摘要】：行政权力监督和制约在我国的政治活动中有着不容忽视的作用,它直接影响着行政机关的行政效果和人民的满意度。如今我国在行政权力监督和制约体制方面依然面临着较大的困难,影响着全面改革的深化。自党的十八大以来,我国加强和完善了对行政权力的监督和制约。十八届三中全会将“强化权力运行制约和监督体系”列入全面改革重大任务。对国家权力机关实施行政监督,将在更大程度上监督和制约权力,不仅要使权力正常运行,而且还要使权力在阳光下更好地运行,为人民服务。本文主要通过文献研究法和实证分析法,对我国的行政权力监督和制约近况进行了具体的分析和研究。总的来说,我国的行政权力监督和制约虽然取得了可喜的成就,但存在的问题也不少,主要表现为监督和制约的范围不全面、举措不及时、渠道不畅通、程序不规范、效果不理想。导致问题出现的原因有很多,但最主要的原因是人大监督和人民群众监督的力度不够,新闻舆论监督缺乏充分的法律和安全保障,以及制度不健全等。根据目前我国行政监督和制约存在的问题,本篇论文进行了深入的研究和探讨,从中找出原因,并且提出完善的意见和建议。主要从以下三个方面着手:首先,加大人大和人民群众对行政权力的监督和制约力度。其次,健全我国关于行政权力监督的法律法规、机制体制,增强法律法规制度对行政权力的监督和制约。最后,要加大政务的透明度,强化社会团体和新闻舆论对行政权力的监督和制约。
[Abstract]:The supervision and restriction of administrative power plays an important role in our country's political activities. It directly affects the administrative effect of administrative organs and the satisfaction of the people. Today, our country still faces great difficulties in the system of supervision and restriction of administrative power and affects the deepening of overall reform. Since the 18 National Congress of the Party, China has strengthened and improved the supervision and restriction of administrative power. The third Plenary session of the 18 CPC Central Committee included "strengthening the power operation restriction and supervision system" as a major task of overall reform, and carried out administrative supervision over state power organs. It will supervise and restrict the power to a greater extent, not only to make the power run normally, but also to make the power run better in the sun, to serve the people. This paper makes a concrete analysis and research on the recent situation of supervision and restriction of administrative power in our country. In general, although the supervision and restriction of administrative power in our country has made gratifying achievements, there are still many problems. The main manifestations are that the scope of supervision and restriction is not comprehensive, the measures are not timely, the channels are not smooth, the procedures are not standardized, and the effect is not satisfactory. There are many reasons for the problems. However, the main reasons are that the supervision of the people's Congress and the masses is not strong enough, the supervision of news and public opinion lacks adequate laws and security guarantees, and the system is not perfect. According to the existing problems of administrative supervision and restriction in our country, This paper has carried on the thorough research and the discussion, from which has found the reason, and proposed the consummation opinion and the suggestion. Mainly from the following three aspects: first, increases the people's Congress and the people to the administrative power the supervision and the restriction dynamics, second, We should improve the laws, regulations, mechanism and system of administrative power supervision in our country, strengthen the supervision and restriction of administrative power by laws and regulations. Finally, we should increase the transparency of government affairs. Strengthen the supervision and restriction of administrative power by social organizations and public opinion.
