石狮市市场监管执法监督问题研究

【摘要】：随着依法治国基本方略的不断推行,社会对依法行政的要求也不断提高,要全面实现依法行政,必须充分依靠行政法制监督机制对行政权力进行有效的监督和制约。近年来,全面依法治国深入推进,对规范市场监管行政执法行为提出更高要求,亟需健全完善市场执法监督机制。2014年底,石狮市探索开展市场监管机构大部制改革,整合工商、食药、质监等部门职责,成立石狮市市场监督管理局,初步建立了新机构的执法监督体系和机制,但在运作中还存在不少问题亟待尽快解决。本文充分应用文献分析法、案例分析法、比较分析法等研究方法,运用分权与制衡理论,在对市场监管执法及市场监管执法监督的一般理论的研究成果进行梳理的基础上,结合笔者自己在石狮市市场监管执法监督岗位的工作实践和掌握第一手资料,全面分析石狮市市场监管执法监督现状。在分析现状的基础上梳理剖析石狮市市场监管执法监督中存在的监督领域覆盖不全、内部监督流于形式,外部监督存在缺位、执法对象的监督缺失、责任追究机制难以落实到位等问题,并分析了存在上述问题的原因,如内部监督机制有待健全、各大监督主体的监督能力有待提升、保障监督的法律法规不完善等。在分析原因的基础上,提出了实现市场监管执法监督领域的全覆盖、重视监管对象的监督、强化权力机关监督制约效果、加强舆论监督效能、完善司法监督、提高市场监管部门内部监督的有效性,完善法律法规建设等对策建议。本文尝试从一线执法者的角度提出建议和对策,为完善石狮市市场监管执法监督机制做抛砖引玉的前期思考。
[Abstract]:With the continuous implementation of the basic strategy of governing the country according to law, the requirements of the society for administration by law are constantly raised. In order to fully realize the administration by law, we must fully rely on the supervision mechanism of the administrative legal system to effectively supervise and restrict the administrative power. To comprehensively administer the country in accordance with the law, put forward higher requirements for standardizing the conduct of market supervision and administrative law enforcement. By the end of 2014, there is an urgent need to improve and improve the market law enforcement supervision mechanism. Shishi City is exploring the development of a large department system reform of market regulatory bodies, and the integration of industry and commerce, food and medicine. The responsibility of quality supervision and other departments, the establishment of Shishi City Market Supervision Administration, the preliminary establishment of a new agency of law enforcement supervision system and mechanism, but in operation there are still many problems need to be resolved as soon as possible. Comparative analysis and other research methods, using the theory of separation of powers and checks and balances, on the basis of combing the research results of the general theory of market supervision and law enforcement supervision, Combined with the author's own work practice and first-hand information in Shishi market supervision and law enforcement supervision post, On the basis of the analysis of the present situation, the existing supervision fields in Shishi market supervision and law enforcement supervision are not complete, the internal supervision is a mere formality, and the external supervision is absent. The lack of supervision of the law enforcement object, the difficulty of implementing the accountability mechanism, and so on. The reasons for the above problems are analyzed. For example, the internal supervision mechanism needs to be improved, and the supervisory ability of the major supervisory bodies needs to be improved. Based on the analysis of the reasons, the author puts forward that the market supervision and law enforcement supervision should cover the whole field, attach importance to the supervision of the object of supervision, strengthen the effect of supervision and restriction by the power organs, and strengthen the effectiveness of public opinion supervision. Improve judicial supervision, improve the effectiveness of internal supervision of market regulators, perfect the construction of laws and regulations and other countermeasures. This paper tries to put forward suggestions and countermeasures from the perspective of front-line law enforcers.
