【摘要】：国际投资始于资本主义发展时期,至1980年以后发展成为国际经济交往中最为重要的形式之一。在此阶段,为吸引和保护国际投资,国际投资协定应运而生。随着国际投资活动的广泛深入发展、全球环境恶化,国际投资与环境保护间的关系日益受到国际社会的关注,环境保护条款被不同程度地纳入了国际投资协定,并不断发展完善。如何平衡投资利益和东道国环境公益、妥善处理投资与环境间的关系,成为外国学者们研究的热点。反观国内,中国在国际投资活动的身份已经发生了变化:从单纯的外资输入国转变为具有外资输入和资本输出双重身份的发展中大国,以往的投资政策已难以应对新局势。建立于这一认识基础之上,本文对现有国际投资协定中的环境保护条款及相关案例进行研究分析,发现存在的问题,并结合我国的现状,对国际投资及环境保护提出自己的观点。除导语和结语外,本文共分四章:第一章介绍环境保护条款纳入国际投资协定的背景,阐述环境保护条款纳入国际投资协定的缘由和正当性。第二章为国际投资协定中环境保护条款的内容。本章通过横向、纵向对比,并着重对具有代表性的投资协定文本进行分析,梳理国际投资协定中环境保护条款的发展脉络。第三章为国际投资与环境保护的冲突与协调。本章对国际投资仲裁案件进行剖析,阐述产生冲突的根源,并提出协调的办法。第四章为我国的实践、不足和对策。本章对我国的实践做法进行研究,发现存在的不足,并提出符合国情的对策。
[Abstract]:International investment began during the period of capitalist development and became one of the most important forms of international economic interaction after 1980. In order to attract and protect international investment, With the extensive development of international investment activities and the deterioration of the global environment, the relationship between international investment and environmental protection has become increasingly concerned by the international community. Environmental protection provisions have been incorporated into international investment agreements to varying degrees, and have been continuously developed and improved. How to balance investment interests with the environmental public good of the host country, and how to properly handle the relationship between investment and the environment, China's status in international investment activities has changed: from a purely foreign investment importing country to a developing country with a dual status of foreign capital import and capital export. The previous investment policy has been difficult to cope with the new situation. Based on this understanding, this paper studies and analyzes the environmental protection clauses and related cases in the existing international investment agreements, finds out the existing problems, and combines the current situation of our country. In addition to the introduction and conclusion, this paper is divided into four chapters: the first chapter introduces the background of the inclusion of environmental protection clauses into international investment agreements. Chapter two is the content of environmental protection clauses in IIAS. And focusing on the analysis of representative texts of investment agreements, Chapter three is the conflict and coordination between international investment and environmental protection. The fourth chapter is the practice, deficiency and countermeasure of our country. This chapter studies the practice practice of our country, finds out the deficiency, and puts forward the countermeasure that accords with the situation of our country.
