【摘要】:城镇化建设的迅速推进,催生了大量小区的产生。数量规模的迅速上升,却出现了小区许多功能性缺位的问题,如诸多商贩在小区叫卖商品占用公共场所,物业服务企业在共有部位悬挂广告条幅、张贴宣传广告等等。由于法律法规对业主知情权的本质属性、主体、范围以及权利行使缺乏可操作性规定,再加上司法实践中对此也存在不同认识,所以,业主如何最大限度地保护知情权,实属重要。本文拟分三章进行研究探讨:第一章详细阐述了业主知情权的基本理论。首先,以知情权作为切入点,进而对业主知情权的权利属性进行探讨。其次,对业主、业主大会和业主委员会等业主知情权的主体性质、成立及运行等进行理论分析。最后,在分析立法不足,以及理论界不同认识的基础上,本文从法定和约定两个方面,对业主知情权的范围进行分析研究。第二章主要分析了业主知情权的实证现状。从中国裁判文书网和北大法宝随机选取17个案例,进行分类筛选,并着重就业主知情权的行使现状进行分析,提炼出司法运行中存在的问题。例如,对于纠纷能否通过业主知情权诉讼解决,业主缺乏综合思量;相关资料和信息对应的义务主体没有进一步明确细化;业主知情权的权利范围,缺乏统一的界定标准;证据举证不能和权利行使的期限是影响业主维权的两大障碍;以及人民法院对业主查阅权的具体形式存在不同认识。第三章重点完善了业主知情权的规则制度。针对业主知情权实践中存在的问题,本文从以下四个方面提出可行性规则制度。第一,业主自身方面。双管齐下,逐步让业主意识权利的存在和现实意义,达到让广大业主积极参与社区活动的目的。第二,立法制度方面。通过创设新的业主自治组织,完善业主知情权范围,引入诉讼时效制度,以及通过推行举证责任倒置和异地管辖等方式,切实维护业主权利。第三,行政介入方面。借助行政机关的指导和监督作用,达到降低业主委员会成立门槛,提高决议有效通过率,以及完善资料的公布和查阅方式,保障业主知情权的实现。最后,司法救济方面。结合实际状况,本文重点就仲裁和简易程序进行分析完善。
[Abstract]:The rapid development of urbanization has given birth to a large number of residential areas. The rapid increase in the number of scale, but there are a lot of functional deficiencies in the community, such as many vendors in the residential areas to sell goods occupied public places, Property service enterprises hang advertising banners in common sites, post advertisements, etc. Due to the lack of operational regulations on the essential attribute, subject, scope and exercise of the right to know of the owner in laws and regulations, In addition, there are different views on this in judicial practice, so how to protect the right to know to the maximum extent is really important. This paper will be divided into three chapters to study: the first chapter elaborates the basic theory of the owner's right to know. Taking the right to know as the starting point, the author discusses the property of the owner's right to know. Secondly, it makes a theoretical analysis of the subject nature, establishment and operation of the owner's right to know, such as the owner, the owners' Congress and the owner's committee. On the basis of analyzing the insufficiency of legislation and the different understanding of the theorists, this paper discusses the two aspects of legislation and agreement. The second chapter mainly analyzes the empirical situation of the owner's right to know. And emphatically analyzes the current situation of the owner's right to know, abstracts the existing problems in the judicial operation. For example, whether the dispute can be resolved through the owner's right to know lawsuit, the owner lacks comprehensive consideration; Relevant information and information corresponding to the obligations of the subject has not been further clarified; the scope of the owner's right to know, lack of a unified definition standard; evidence proof and the time limit of the exercise of rights are two major obstacles affecting the rights of owners; The third chapter focuses on perfecting the rules and systems of the owners' right to know, aiming at the problems existing in the practice of the owners' right to know. This paper puts forward the feasibility rule system from the following four aspects. First, the owner himself, both ways, gradually makes the owner aware of the existence and practical significance of the rights, so as to achieve the purpose of enabling the majority of owners to actively participate in community activities. Second, Legislative system. Through the creation of a new owner's self-governing organization, the improvement of the scope of the owner's right to know, the introduction of the statute of limitations system, and the implementation of the inversion of the burden of proof and jurisdiction in different places, the owners' rights can be effectively safeguarded. Third, In the aspect of administrative intervention, with the help of the guidance and supervision role of the administrative organ, the threshold for the establishment of the owners' committee is lowered, the effective pass rate of the resolution is increased, and the publication and access of the information is improved to ensure the realization of the owner's right to know. Judicial relief. Combined with the actual situation, this paper focuses on arbitration and summary procedures for analysis and improvement.
