基于制度反腐的党内法规与国家法律有效衔接研究

【摘要】：党的十八届四中全会提出的“把党内法规体系纳入到中国特色社会主义法治体系中,将党纪与国法更好的融合起来”,肯定了纪法衔接理论研究的重要性。党的十八届六中全会提出“要以更大力度管党治党”,再一次提高了对“全面从严治党”的重视程度。中央纪律检查委员会第七次全体会议总结十八大以来的工作经验,提出“全面从严治党,必须抓住严肃党内政治生活这个根本,扎紧制度笼子,强化党内监督。”这说明“制度反腐”在推进党风廉政建设和反腐败斗争中有着十分重要的作用。党内法规是党的各项纪律要求的制度化形态,党内法规与国家法律都是实现依法治国的基础,也是“制度反腐”不可或缺的左膀右臂。基于制度反腐,要实现依法治国和依规治党的有机统一,使二者更能高效率惩治腐败犯罪,需要明确党内法规与国家法律有哪些不同的功能。同时,还要使党内法规和国家法律合理区分又有效衔接:合理区分主要是区分党内法规与国家法律的不同界限、不同领域和不同标准;有效衔接主要是实现党内法规与国家法律目标指向的有效衔接、规范对象的有效衔接、和内容实体的有效衔接。党内法规与国家法律也会出现衔接不畅的问题,需要我们确立二者衔接要坚持哪些基本原则,如何才能加强党内法规制定与国家立法之间的沟通与协调,解决二者衔接之间的障碍,共同构建制度的笼子,强化权力制约监督,努力构建领导干部不敢腐、不能腐、不想腐的长效机制。

Inner-party laws and regulations are the institutionalized form of the Party's various disciplinary requirements. Both inner-party laws and national laws are the basis for administering the country according to law, and they are also indispensable for "institutional anti-corruption." based on institutional anti-corruption, the organic unity of governing the country according to law and governing the party in accordance with regulations is to be realized. To make them more efficient in punishing corruption crimes, it is necessary to clarify the different functions of inner-party laws and national laws. At the same time, The reasonable distinction between the inner-party law and the national law should be effectively connected: the reasonable distinction is mainly to distinguish the different boundaries between the inner-party laws and the national laws, different fields and different standards; Effective cohesion is mainly to realize the effective connection between the inner-party law and the national law, the effective connection between the normative object and the content entity, and the problem that the inner-party law and the national law will not be connected smoothly. It is necessary for us to establish which basic principles to adhere to, how to strengthen the communication and coordination between the formulation of laws and regulations within the Party and the national legislation, to solve the obstacles between the two, to build the cage of the system together, and to strengthen the supervision of power restriction.
