【摘要】：习近平法治建设思想具有深邃的思想内涵、鲜明的理论风格、务实的实践导向,是中国特色社会主义法治理论的最新成果,是21世纪中国马克思主义法治思想的系统表达,是推进“四个全面”战略部署的重要手段,是全面依法治国、建设法治中国、推进法治强国的理论基础和指导思想。本人拟从“科学立法、严格执法、公正司法、全民守法”十六字方针进行具体论述,来研究探讨习近平法治建设思想的理论本质、理论风格和理论价值,透视习近平法治建设思想坚实的实践基础和厚重的人文哲学底蕴、以及习近平法治建设思想的时代特征、中国特色和习式风格。习近平站在新的历史起点,从坚持和发展中国特色社会主义道路的战略高度,运用辩证唯物主义与历史唯物主义法律观的基本原理,对全面依法治国的战略考量、根本遵循、推进方略、动力机制等一系列重大理论与实践问题进行悉心思考和深入研究,深刻揭示中国特色社会主义法治发展的基本规律,形成了内涵丰富、体系严整的法治建设思想理论系统,从而有力推动了中国特色社会主义法治理论的创新发展,为全面推进依法治国、加快实现“中国梦”提供了科学的理论指南。从习近平法治建设思想形成的过程、主要观点内容、及其现实价值三个方面进行进一步研究探讨,科学归纳总结了习近平法治建设思想。其中就第一部分序言,主要针对选题依据、选题意义,国内研究现状及其文献综述,研究方法和概念界定四个方面进行论述。第二部分主要论述习近平法治建设思想形成的条件和形成过程,包含形成的背景、形成的理论基础、形成的过程三个方面。第三部分主要论述习近平法治建设思想主要内容,包含科学立法,完善法律体系;严格执法,建设法治政府;公正司法,维护公平正义;全民守法,建设法治社会四方面内容。第四部分为习近平法治建设思想的当代意义,包含两部分,其中理论意义包括:继承和发展中国特色社会主义法治建设方针,深化和完善党的法治化建设思想。实践意义包括:为法治中国的建设提供行动指南,为全面建设小康社会提供了法治保障,为全面深化改革提供了动力支撑。
[Abstract]:Xi Jinping's thought of building the rule of law has profound ideological connotation, bright theoretical style and pragmatic practical guidance. It is the latest achievement of the theory of ruling by law with Chinese characteristics and the systematic expression of the thought of Chinese Marxism ruling by law in the 21st century. It is an important means to advance the "four comprehensive" strategic arrangements, and is the theoretical basis and guiding ideology of ruling the country according to law, building a country ruled by law, and promoting a powerful country under the rule of law. In order to study the theoretical essence, theoretical style and theoretical value of Xi Jinping's thought on the construction of the rule of law, and to see through the solid practical foundation and the heavy humanistic philosophical background of the thought of building the rule of law of Xi Jinping, the 16-character guideline of "abiding by the law for all people" is discussed in detail. As well as the characteristics of the times, the Chinese characteristics and the traditional style of Xi Jinping's thought of building the rule of law. Xi Jinping stands at a new historical starting point, from the strategic height of adhering to and developing the road of socialism with Chinese characteristics, Using the basic principles of dialectical materialism and historical materialism, we have carefully considered and deeply studied a series of important theoretical and practical issues, such as the strategic consideration, fundamental adherence, promotion strategy, motive mechanism, and so on, of the overall administration of the country according to law. The basic law of the development of the rule of law of socialism with Chinese characteristics has been deeply revealed, and the ideological and theoretical system of the construction of the rule of law with rich connotation and strict system has been formed, which has contributed to the innovation and development of the theory of the rule of law with Chinese characteristics. In order to advance the rule of law in an all-round way and speed up the realization of "Chinese Dream", it provides a scientific theoretical guide. Further research and discussion are made from three aspects: the formation of Chinese Dream's thought on the construction of the rule of law, the contents of his main viewpoints, and his practical value. In the first part of the preface, it mainly aims at the basis of selecting the topic, the significance of the topic, the current situation of domestic research and the literature review. The second part mainly discusses the forming conditions and forming process of Xi Jinping's thought of building the rule of law, including the background of formation, the theoretical basis of formation. The third part mainly discusses the main contents of Xi Jinping's thoughts on the rule of law, including scientific legislation, perfecting the legal system, strictly enforcing the law, building a government ruled by law, just judicature, safeguarding fairness and justice, abiding by the law of the whole people, The fourth part is the contemporary significance of Xi Jinping's thoughts on the construction of the rule of law, which includes two parts. The theoretical significance includes: inheriting and developing the policy of building socialist rule of law with Chinese characteristics. The practical significance of deepening and perfecting the Party's thought of rule by law includes: providing the guide for action for the construction of China ruled by law, providing the guarantee of rule of law for the construction of a well-off society in an all-round way, and providing the motive force for deepening the reform in an all-round way.
