论赞比亚中资企业对当地劳工权益的法律保护

【摘要】:近年来,中资企业在赞比亚的投资规模不断扩大,招募的当地劳工日益增加,中资企业对当地劳工权益的保护也愈加受到中赞两国的关注。虽然赞比亚关于劳工权益保护的法律法规较完善,但由于经济欠发达,就业形势严峻,加上部分赞比亚中资企业过于注重盈利,因而对当地劳工权益保护不足的现象仍然存在。赞比亚中资企业对当地劳工权益保护不足主要体现在以下五个方面:第一,赞比亚中资企业对当地劳工工作权法律保护不到位。如:赞比亚中资企业不与当地劳工签订劳动合同,赞比亚中资企业给当地劳工提供的就业机会不平等且不太重视工会组织的作用等;第二,赞比亚中资企业对当地劳工休假权法律保护不到位。如:部分赞比亚中资企业为了提高生产效益,增加企业利润,减少当地劳工的假期;第三,赞比亚中资企业对当地劳工职业健康与安全权法律保护不到位。如:赞比亚中资企业内部基础安全设施供应不足,为当地劳工提供的工作条件不够优越,不能有效保护当地劳工的职业健康与安全;第四,赞比亚中资企业对当地劳工劳动报酬权法律保护不到位。如:过分追求利润,给予当地劳工的劳动报酬太低,并且存在拖欠当地劳工劳动报酬的现象;第五,赞比亚中资企业对当地劳工社会保障权法律保护不到位。如:中资企业为当地劳工提供的保险福利、住房福利、交通补贴等不够充分。存在这些不足的主要原因有:中资企业对赞比亚的劳动法不够熟悉;企业内部的管理制度存在不足;中资企业的法律意识不强;赞比亚执法部门未认真执行劳动法;当地国际型管理人才紧缺。赞比亚中资企业对当地劳工权益的法律保护主要应该从以下两个方面来完善:(1)完善赞比亚中资企业内部当地劳工权益的保护措施:加强内部协商、积极承担社会责任、依法完善管理制度、增强法律意识、借鉴他国苦情处理制度;(2)完善赞比亚中资企业外部当地劳工权益的保护措施:双方政府或相关部门斡旋、重视企业外工会的作用、完善赞比亚劳动争议处理制度。减少中资企业与当地劳工的劳资冲突,高效解决中资企业与当地劳工的劳资纠纷。为实现“互利合作,共同发展”目标,中国政府应该有更明确的指导意见,加强对跨国企业的监管,加强对外宣传力度,避免外界对中资企业的曲解,向全世界展示更好的中国形象。
[Abstract]:In recent years, the investment scale of Chinese enterprises in Zambia has been expanding, the recruitment of local workers is increasing, and the protection of local labor rights and interests by Chinese enterprises is becoming more and more concerned by the two countries. Although the laws and regulations on the protection of labor rights and interests in Zambia are more perfect, the employment situation is grim, and some praise is added. The lack of local labor rights and interests in the local labor rights and interests of the Chinese enterprises in Zambia is mainly reflected in the following five aspects: first, the Chinese enterprises in Zambia are not in place to protect the local labor rights. For example, the Chinese enterprises in Zambia are not with the local enterprises. Labor contracts are signed by labor, and the employment opportunities provided by Chinese enterprises in Zambia to local workers are not equal and not too much attached to the role of trade unions. Second, the legal protection of the right to leave the local workers is not in place by the Chinese enterprises in Zambia. For example, some Chinese enterprises in Zambia can increase the profits of the enterprises, increase the profits of the enterprises, and reduce the local labor. Third, the legal protection of the local workers' occupational health and safety is not in place in Zambia. For example, the insufficient supply of the basic security facilities in the Chinese enterprises in Zambia is insufficient and the working conditions for the local workers are not superior enough to effectively protect the occupational health and safety of the local workers; and fourth, the Chinese enterprises in Zambia are on the right side. The legal protection of the remuneration right of labor labor is not in place. For example, the excessive pursuit of profit, the low remuneration for local labor, and the phenomenon of arrears of local labor remuneration; fifth, the legal protection of the local labor social security rights in the Chinese enterprises in Zambia is not in place. The main reasons are: the labor law of the Chinese enterprises is not familiar with the labor law in Zambia; the internal management system in the enterprises is insufficient; the legal consciousness of the Chinese enterprises is not strong; the law enforcement departments in Zambia are not conscientiously executing the labor law; the local international management talents are short. The Chinese enterprises in Zambia are in short supply. The legal protection of the local labor rights and interests should be improved from the following two aspects: (1) improving the protection measures for the local labor rights and interests of the Chinese enterprises in Zambia: strengthening internal consultation, actively taking on social responsibility, perfecting the management system according to law, strengthening the legal consciousness, drawing on the system of dealing with the bitter situation in other countries, and (2) perfecting the Chinese enterprises in Zambia. The protection measures of external local labor rights: both governments and relevant departments mediate, attach importance to the role of trade unions outside the enterprise, improve the labor dispute handling system in Zambia, reduce the labor and capital conflicts between Chinese enterprises and local workers, and effectively solve the disputes between Chinese and local labor. The government should have more clear guidance, strengthen the supervision of the multinational enterprises, strengthen the publicity to foreign countries, avoid the misinterpretation of the foreign enterprises and show the better image of China to the whole world.
