基于FRAM的国家安监局安全监管职能研究

【摘要】：我国政府向来十分重视安全生产监督管理工作,目前国内安全形势的好转,很大程度要归功于政府的安全监管。可是近年来,我国接连发生了多起震惊全国的特别重大安全生产责任事故,如天津港“8·12”特大火灾爆炸事故与深圳市“12·20”特别重大滑坡事故。这些事故的背后,都反映出政府的安全监管职能存在缺失。但同时,我国政府机构庞大,各部门之间存在一定程度的职能分配不明确、不完善,甚至不合理。另一方面,日益增长的中小企业数量和日渐复杂的行业交叉情况,使得政府的安全监管压力变得越来越大,不可避免的就会出现问题。所以,对我国政府的安全监管职能进行研究十分重要。因此,本文将以政府安全监管的主体实施机关——国家安全生产监督管理总局为研究对象,根据法律、法规与国家行政文件中对其职责的具体规定,分析职责识别出其具体职能共有十五条:“起草法律法规草案、行业规范标准、规章制度”、“拟定安全生产方针规划”、“安全生产执法”、“安全指导”、“安全生产审批准入”、“事故调查”、“危险源隐患排查治理”、“组织安全大检查、专项督查”、“应急救援”、“安全统计分析”、“职业资格鉴定”、“监管中介机构”、“安全科学研究推广”、“职业病监管”与“安全教育”。随后,依据安全科学理论并参照英国健康安全执行局(HSE)的职能划分,对国家安全生产监督管理总局的职能进行统合与分类。经分类后,国家安全生产监督管理总局具有的职能有“拟定规划”、“立法立规”、“执法”、“事故调查”、“应急救援”、“行政监察”、“科研推广”与“统计分析”八个方面。接着通过运用功能共振分析方法(FRAM),对上述八项职能的输出内容、重要度与易出错度这三方面进行分析,得出“执法”与“行政监察”职能比较容易发生变化,“拟定规划”与“统计分析”职能比较重要,最后针对分析结果,对国家安全生产监督管理总局提出建议,为我国政府安全生产监督管理工作的提升提供参考。
[Abstract]:Our government has always attached great importance to the supervision and management of production safety. At present, the improvement of the domestic safety situation is largely due to the safety supervision of the government. However, in recent years, there have been many accidents which shocked the whole country, such as the "8 / 12" fire and explosion accident in Tianjin Port and the "12 ~ 20" landslide accident in Shenzhen City. Behind these accidents, all reflect the absence of the government's safety supervision function. But at the same time, the government organization in our country is huge, and the function distribution between different departments is not clear, perfect, or even reasonable. On the other hand, the increasing number of small and medium-sized enterprises and the increasingly complex cross-industry situation make the pressure of government safety supervision become more and more, and inevitably problems will occur. Therefore, it is very important to study the safety supervision function of our government. Therefore, this paper will take the State Administration of production Safety Supervision and Administration, the main implementing organ of government safety supervision, as the research object, according to the specific provisions of its duties in the laws, regulations and state administrative documents. The specific functions identified by the analysis are as follows: "drafting draft laws and regulations, standards of industry standards, rules and regulations", "drawing up guidelines for production safety", "enforcing the law on production safety", and "guidance on safety", "Safety production approval and admission", "accident investigation", "investigation and treatment of hidden dangers of dangerous sources", "organize safety inspection, special supervision", "emergency rescue", "safety statistics analysis", "professional qualification appraisal", Regulatory intermediaries, Safety Scientific Research Promotion, Occupational Disease Supervision and Safety Education. Then, according to the theory of safety science and the function division of HSE, the functions of the State Administration of production Safety Supervision and Administration are integrated and classified. After classification, the State Administration of production Safety Supervision and Administration has the functions of "drawing up plans", "Legislative regulations", "Law Enforcement", "accident investigation", "Emergency Rescue", "Administrative Supervision", "Scientific research promotion" and "statistical analysis" eight aspects. Then, by using the method of functional resonance analysis, the output content, importance and error-prone degree of the eight functions mentioned above are analyzed, and it is concluded that the functions of "law enforcement" and "administrative supervision" are easy to change. The functions of "drawing up the plan" and "statistical analysis" are more important. Finally, according to the results of the analysis, the author puts forward some suggestions to the State Administration of production Safety Supervision and Administration, and provides a reference for the promotion of the work of our government in the supervision and management of production safety.
