论法律仪式对宪法信仰的作用

【摘要】：党的十八届四中全会明确提出宪法日与宪法宣誓制度,这是建国以来第一次在党的正式文件中规定了法律仪式,体现宪法文化的重要性。这开创了我国在全民族中培育宪法文化和树立宪法权威的新时代。随后,十二届全国人大常委会第十五次会议上以法律形式明确宪法宣誓制度。宪法日与宪法宣誓制度的确立丰富了法律仪式的内涵,为我国从法律仪式角度研究宪法信仰带来了契机。本文共分为四个部分。第一部分从法律仪式、宪法信仰的概念着手,进而分析法律仪式与宪法信仰关系原理,明确二者之间关系。第二部分从法律仪式强化宪法神圣性、增强宪法认同感、推动宪法信仰、传播宪法文化四个角度阐述法律仪式对宪法信仰的意义。第三部分从宪法理念、宪法制度、宪法文化三个层次对于我国宪法信仰缺失的表现进行描述。第四部分就如何在法律仪式中培育宪法信仰进行表述。笔者认为可以从完善法律仪式制度、普及法律仪式宣传、创新法律仪式、培育法律人才四方面对于宪法信仰进行培育,从而促进我国宪法信仰的发展。
[Abstract]:The fourth Plenary session of the 18th CPC Central Committee explicitly proposed the constitution day and the constitutional oath system, which was the first time since the founding of the people's Republic of China that the legal ceremony was stipulated in the Party's official document, which reflected the importance of constitutional culture. This opened a new era of cultivating constitutional culture and establishing constitutional authority in the whole nation. Subsequently, at the 15 th meeting of the standing Committee of the National people's Congress (NPC), the constitutional oath system was clarified by law. The establishment of the constitution day and the constitution oath system enriches the connotation of the legal ceremony and brings the opportunity to study the constitutional belief from the angle of the law ceremony. This paper is divided into four parts. The first part begins with the concept of legal ritual and constitutional belief, and then analyzes the principle of the relationship between legal ritual and constitutional belief, and clarifies the relationship between them. The second part expounds the significance of legal ceremony to constitutional belief from four angles: strengthening the sanctity of constitution, strengthening constitutional identity, promoting constitutional belief and spreading constitutional culture. The third part describes the lack of constitutional belief in our country from three levels: constitutional concept, constitutional system and constitutional culture. The fourth part describes how to cultivate constitutional beliefs in legal ceremonies. The author believes that the constitutional belief can be cultivated from four aspects: perfecting the legal ritual system, popularizing the legal ritual propaganda, innovating the legal ceremony, and cultivating legal talents, so as to promote the development of the constitutional belief in our country.
