网络房屋短租交易平台提供商民法地位研究

【摘要】:共享经济方兴未艾,伴随着共享经济模式出现了多种新型商业模式,包括时下最为火热的共享单车、网络拼车、共享房屋等。新型商业模式的出现改变人们传统生活方式的同时,也面临着法律风险。各地相继爆出的法律纠纷已层出不穷,但有些解决方案虽然合法却不合理,传统法律无法解决新出现的事物是重要原因。而本文所关注的共享房屋领域也存在这一问题。因其法律关系已经重新建构,一旦出现纠纷套用传统法律模型是不适当的,旧有模式不能恰当分配其权利义务关系。与时俱进,研究新生事物以构建符合其特点的民事体系成为必然选择。而目前尚未有专门的学术著述对这一问题进行探讨。故笔者以网络房屋短租交易平台提供商的民法地位作为研究内容,希冀对这一研究对象做出系统的探讨,填补这一空白。笔者相信,当其建立合理的符合其模式的民事体系之后,规范这一事物,使得权利义务更加明确,法律纠纷更少,将会促进共享房屋在我国的快速发展。本文围绕这一主题讨论了五个方面的问题。一是讨论了相关概念,区分了网络交易、网络交易平台、网络房屋短租交易平台等相关概念,为后续的讨论奠定了基础。二是讨论了网络房屋短租交易平台提供商的法律地位,经过对前人学者观点的分析及现实考量,认为网络房屋短租交易平台提供商的法律地位不符合现存法律模型,应当认定其为一种新型的中介更为合适,其构成的基本要素为构建和运营网络交易平台;独立于交易双方,对房东及房屋有更严格的审查;通过网络完成预定。三是讨论了网络房屋短租交易各方的权利义务,从合同约定与法律规定两方面入手,创新性地提出了各方的权利义务,尤其是平台提供商对房屋的实质审查义务尤其重要。四是讨论了网络房屋短租交易平台提供商的法律责任,分析比较了欧盟、美国、澳大利亚及我国的现存模式,提出网络房屋短租交易平台应建立责任体系,一般情况下承担过错责任,做出更有利于消费者的承诺则承担无过错责任。五是讨论了以上研究结论的实现途径,分析比较法律规章、行业自律规范、合同示范文本等各种方式,得出在我国实际情况下以条例为载体是较优选择。
[Abstract]:The sharing economy is in the ascendant, with the emergence of a variety of new business models, including the most popular shared bicycle, Internet carpool, shared housing and so on. The emergence of new business model changes people's traditional way of life, but also faces legal risks. Legal disputes have sprung up one after another all over the world, but some solutions are legal but unreasonable, and traditional law can not solve the new problems is an important reason. And this paper concerns the field of shared housing also exists this problem. Because its legal relationship has been re-constructed, once disputes apply the traditional legal model is inappropriate, the old model can not properly allocate its rights and obligations. Keeping pace with the times and studying new things in order to build a civil system in accordance with its characteristics has become an inevitable choice. At present, there has not been a special academic writings to explore this issue. Therefore, the author takes the civil law status of the short rental trading platform provider of the network house as the research content, hoping to make a systematic discussion on this research object and fill in this blank. The author believes that when it establishes a reasonable civil system in accordance with its model, standardizing this matter, making rights and obligations more clear, legal disputes less, will promote the rapid development of shared housing in China. This paper discusses five problems around this theme. The first is to discuss the related concepts, distinguish the related concepts such as network transaction, network trading platform, network house short lease transaction platform, etc., and lay the foundation for the following discussion. The second is to discuss the legal status of the providers of the short lease trading platform of the network housing. After analyzing the views of the predecessors and considering the reality, the author thinks that the legal status of the providers of the short lease trading platform of the network houses does not conform to the existing legal model. It should be considered as a new type of intermediary, the basic element of which is to construct and operate the online trading platform, independent of the parties to the transaction, to have a more strict examination of the landlord and the house, and to complete the reservation through the network. The third is to discuss the rights and obligations of the parties involved in the short lease transaction of network housing, starting with the contract agreement and the legal provisions, and innovatively proposing the rights and obligations of the parties, especially the essential obligation of the platform provider to examine the housing. Fourth, it discusses the legal liability of the providers of the short lease trading platform of the network housing, analyzes and compares the existing models of the European Union, the United States, Australia and China, and puts forward that the short lease trading platform of the network housing should establish the liability system. In general, take fault liability, make a more favorable commitment to consumers to assume no fault liability. The fifth is to discuss the way to realize the above conclusion, to analyze and compare the laws and regulations, the industry self-discipline norm, the contract model text and so on, and to draw the conclusion that the better choice is to take the regulation as the carrier under the actual situation of our country.
