新时期农民法治意识培育的生活化路径研究

【摘要】：十一届三中全会的召开标志我国进入改革开放的新时期,同时也标志法治建设进入新阶段。法治意识是法治国家建设的精神支撑,直接关系到一国法治的进程。因此,法治意识的培育显得尤为重要。然而,由于社会和历史等方面的原因,农民的法治意识较为薄弱,农村法治建设比较落后,严重影响到国家法治化的进程。因此,提高农民法治意识对法治中国的建设具有重要的现实意义。本文以新时期农民法治意识的培育路径为主要的研究内容,试图在马克思生活世界观的指导下,反思当下农村法治意识培育的现状,并从培育主体、传统法治教育及环境等方面进行原因分析。最后以生活化的视角构建农民法治意识培育的有效性路径,将法治教育渗透在农民日常生活之中,使农民在潜移默化之中增强法治意识。全文分五章进行论述。第一章为绪论。主要是对这一选题的研究背景、研究目的、研究意义、研究综述、创新点进行介绍。在搜集相关资料的基础上,概括总结出国内外学者关于农民法治意识及其生活化的研究现状,并在此基础上指出本文的创新点。第二章为新时期生活化在农民法治意识培育中合理性与必要性。本章主要分三个部分,第一部分是对相关概念及其理论基础进行介绍,第二部分是从回归主体、回归生活与回归实践三个方面对生活化在农民法治意识培育中运用的合理性进行概述。第三部分主要论述生活化运用的必要性,主要从农民自身发展的要求、农民法治意识培育的需要两个方面进行论述。第三章为新时期农民法治意识培育中生活化缺失的现状。主要在查阅资料和相关文献的基础上,归纳总结出现阶段农民法治意识培育中生活化缺失的现状,主要从目标、内容、方式、过程与农民生活世界疏离方面进行概述。第四章为新时期农民法治意识培育中生活化缺失的原因分析。主要从法治意识培育者、农民自身影响因素、传统法治教育及其农村社会环境四个方面分析了当前农民法治意识培育中生活化缺失的原因。第五章为探究新时期农民法治意识培育的生活化路径。本章是全文的重点,主要是针对农民法治意识培育中出现的问题,在反思的基础上提出农民法治意识培育生活化路径即法治意识培育主体置身于生活、目标贴近于生活、内容取材于生活、方式来源于生活以及营造生活化的法治氛围。
[Abstract]:The convening of the third Plenary session of the 11th CPC Central Committee marks a new period of reform and opening up and a new stage in the construction of the rule of law. The consciousness of the rule of law is the spiritual support of the construction of a country ruled by law, which is directly related to the process of the rule of law in a country. Therefore, the cultivation of awareness of the rule of law is particularly important. However, due to social and historical reasons, farmers' awareness of the rule of law is relatively weak, and the construction of rural rule of law is relatively backward, which seriously affects the process of the rule of law in the country. Therefore, improving farmers' awareness of the rule of law is of great practical significance to the construction of China under the rule of law. Taking the cultivation path of farmers' consciousness of rule of law in the new period as the main research content, this paper tries to reflect on the current situation of cultivation of the consciousness of rule of law in rural areas under the guidance of Marx's world outlook on life, and from the cultivation of the main body. The traditional education of rule of law and the environment are analyzed. Finally, it constructs the effective path of cultivating farmers' consciousness of rule of law from the perspective of life, penetrates the education of rule of law into the farmers' daily life, and makes peasants strengthen their consciousness of rule of law in the process of imperceptibly changing. The full text is divided into five chapters. The first chapter is the introduction. This paper mainly introduces the background, purpose, significance, summary and innovation of this topic. On the basis of collecting relevant data, this paper summarizes the present situation of the research on peasants' consciousness of ruling by law and their life, and points out the innovation of this paper. The second chapter is the rationality and necessity of life in the cultivation of farmers' consciousness of rule of law. This chapter is mainly divided into three parts, the first part is to introduce the related concepts and their theoretical basis, the second part is to return to the main body, This paper summarizes the rationality of the application of life in the cultivation of farmers' consciousness of rule of law from three aspects of returning to life and returning to practice. The third part mainly discusses the necessity of life application, mainly from two aspects: the requirement of farmers' own development and the need of cultivating farmers' consciousness of rule of law. The third chapter is the status quo of farmers'living deficiency in the cultivation of farmers' consciousness of rule of law in the new period. On the basis of consulting data and related documents, this paper summarizes the present situation of the lack of life in the cultivation of farmers' consciousness of rule of law, mainly from the aspects of goal, content, way, process and alienation of peasants' life world. The fourth chapter analyzes the causes of the lack of life in the cultivation of farmers' consciousness of rule of law in the new period. This paper mainly analyzes the reasons of the lack of life in the cultivation of farmers' consciousness of rule of law from four aspects: the cultivator of the consciousness of rule of law, the influencing factors of farmers themselves, the traditional education of rule of law and the rural social environment. The fifth chapter is to explore the way to cultivate farmers' consciousness of rule of law in the new period. This chapter is the focus of the full text, mainly aiming at the problems in the cultivation of farmers' consciousness of rule of law. On the basis of reflection, the author puts forward the way to cultivate farmers' consciousness of rule of law, that is, the subject of cultivation of consciousness of rule of law is placed in life, and the goal is close to life. The content is based on life, the way comes from life and creates a living atmosphere of rule of law.
