互联网视域下消费者权益保护法律问题研究

【摘要】:在信息技术时代,互联网技术蓬勃发展,互联网交易模式兴起,为消费者提供了足不出户购买商品和服务的可能性。互联网交易扩大了消费者的选择范围,提高了效率,更降低了交易的成本,惠及互联网市场各个交易主体。但是,也正是因为互联网具有虚拟性、便捷性与开放性等特点,让消费者与经营者间信息不对称的趋势更加显著,导致互联网消费者更为弱势的地位。近年来,互联网消费者的权益保护问题已经得到了社会各界的广泛关注,为适应快速发展、变幻莫测的互联网市场,我国出台了新的《消费者权益保护法》,以期在原有法律的基础之上更好的保护互联网消费者的权益。但是由于互联网交易引发的法律问题具有其特殊性,较传统交易的保护更为困难,前所作出的调整还很难适应互联网市场发展速度。面对互联网交易市场的迅猛发展,以及互联网消费者权益保护的紧迫形势,首先应清楚互联网交易自身独有的特性,了解互联网交易中主体的复杂性。通过对互联网交易特殊性的分析,从知情权、安全权、公平交易权、隐私权以及求偿权五个角度出发,提出保护互联网消费者权益时不足之处。其次结合我国相关立法的现状,分析新消法中新增条文的改进与不足。再通过对域外相关立法的分析与借鉴,以期对我国有关于互联网消费者保护的相关规定有所借鉴。最后从立法、行政监管机制与司法救济机制三个方面提出建议,维护我国互联网消费者的合法权益,推进互联网经济的稳步发展。
[Abstract]:In the age of information technology, the rapid development of Internet technology and the rise of Internet trading mode provide consumers with the possibility of buying goods and services without leaving home. Internet transaction expands the range of consumers' choice, improves the efficiency, reduces the transaction cost, and benefits all trading bodies in the Internet market. However, it is precisely because the Internet has the characteristics of virtual, convenient and open, so that the information asymmetry between consumers and operators is more significant, leading to a more vulnerable position of Internet consumers. In recent years, the protection of the rights and interests of Internet consumers has received extensive attention from all walks of life. In order to adapt to the rapid development and unpredictable Internet market, In order to protect the rights and interests of Internet consumers on the basis of the original laws, China has issued a new Consumer Rights and interests Protection Law. However, due to the particularity of the legal problems caused by Internet transactions, it is more difficult than the protection of traditional transactions, the adjustment made before is difficult to adapt to the speed of the development of the Internet market. In the face of the rapid development of the Internet trading market and the urgent situation of protecting the rights and interests of Internet consumers, we should first understand the unique characteristics of Internet transactions and understand the complexity of the main bodies in Internet transactions. Through the analysis of the particularity of Internet transaction, from the five angles of the right to know, the right to security, the right to fair trade, the right to privacy and the right to claim, the shortcomings of protecting the rights and interests of Internet consumers are put forward. Secondly, combined with the current situation of relevant legislation in our country, analyzes the improvement and deficiency of the new provisions in the new law. Through the analysis and reference of the relevant legislation, the author hopes to draw lessons from the relevant regulations on Internet consumer protection in China. Finally, suggestions are put forward from three aspects: legislation, administrative supervision mechanism and judicial relief mechanism, to safeguard the legitimate rights and interests of Internet consumers in China and to promote the steady development of Internet economy.
