农民工子女受教育权的平等保护

【摘要】：近年来,农民工子女受教育权问题引起社会各界的广泛关注。由于区域经济发展不平衡、地方保护主义作祟、择优教育观念的冲击等现实层面的原因,以及户籍制度的影响、教育法律法规缺乏可操作性、权利救济机制不健全等制度层面的原因,农民工子女的入学机会、受教育的条件和受教育过程都与拥有城市户籍的儿童不平等。国家应尽快制定专门的《反教育歧视法》,以保障农民工子女受教育平等权的充分实现。
[Abstract]:In recent years, the issue of the right to education of migrant workers' children has attracted wide attention from all walks of life. Due to the imbalance of regional economic development, the local protectionism, the impact of the idea of preferential education, and the impact of the household registration system, the educational laws and regulations are lack of maneuverability. The rights relief mechanism is not perfect and so on. The children of migrant workers are not equal to the children with urban household registration in terms of the opportunity to attend school, the conditions of education and the process of education. The state should formulate a special Anti-Educational Discrimination Law as soon as possible in order to ensure the full realization of the equal right to education for the children of migrant workers.
