学前教育阶段受教育权保障的国家义务研究

【摘要】:学前教育阶段受教育权是指学前儿童有接受文化教育和获得受教育物质帮助的权利,是宪法和法律赋予公民的基本权利。幼儿在学前教育阶段受教育权实现过程中,国家承担着尊重、给付与保护的义务。国家尊重义务是指通过对学前教育内容和方法、学前教育场所、学前教育形式的规定,达到尊重学前儿童及其监护人自由选择学前教育的权利;国家给付义务是指国家应当通过物质性给付、服务性给付和制度性给付等方式,为学前教育主体受教育权的实现提供相应利益;国家保护义务是指国家应当从立法、行政、司法等方面来保障幼儿学前教育阶段的受教育权。
[Abstract]:The right to education in preschool education refers to the right of preschool children to receive cultural education and material assistance from education, which is a basic right given to citizens by the Constitution and laws. The obligation of the State to respect, pay and protect refers to the adoption of provisions on the contents and methods of pre-school education, the place of preschool education, and the form of pre-school education. To achieve respect for the right of preschool children and their guardians to freely choose pre-school education; the obligation of state payment means that the state shall pay by means of material, service and institutional benefits, etc. The duty of state protection means that the state should protect the right to education in preschool education from the aspects of legislation, administration and judicature.
